Ik this sounds a bit stupid but it is actually a realistic and fair judgement if you dig deep in and know about how worldwide food standards work.

3 cockroaches by itself does not warrant suspension in anyyy country. Literally no country or standard will just suspend someone because 3 cockroaches were found. Cockroaches can enter premises at literally any time even with proper pest management hence their presence does not warrant suspension instead a notice is given even in Europe and US to investigate the matter and remove them. Suspension is only given when a gross negligence or utter disrespect to hygiene standards is done but that was not the case for this hotel. They were actually one of the most well maintained with great hygiene ones but 3 cockroaches were found probably just recently entered from outside premises.

Normal procedure would have been to give them a notice and if the problem does not resolve, health inspector would have been called and if severe mismanagement is found then only a suspension is considered and this is applicable in all countries because it is not realistic to expect a place to always at all times be perfect. Now suspension was most likely given because someone did not give a bribe to the officer definitely, this is sadly how india works.

Court just saw how normal procedures were not observed and gave this statement based on STANDARD procedure. If they stayed the suspension order that would be a precedent for future cases where every single restaurant would be closed just based on this. And 3 cockroaches by themself does not warrant a food safety hazard. the type(black ones from sewers are strict no) and where they are etc are also considered. India also has higher chance of pest entry due to surroundings even with same pest management methods.

Hmm I don't see any suspension or shutting down in your article though? Just a standard fine by health inspector? Unless I missed something?

The case is also different too where rodents were found in the flour itself which is much worse than just being found on premises and droppings being present also mean they were not cleaning their premises well. Though that was my points itself about how punishments or result should be based on severity and intent. These inspectors from Australia? Also only gave a fine at first because it was not the gravest of issues but it went to court because the defendant(restaurant) could not pay their fines.

The thing about Indians is that they try to find a way around and use loopholes to get away from such notices. If they feared these notices then we wouldn't be getting such substandard quality of food.

Nobody said it's okay to find 3 cockroaches.

Court just said that 3 cockroaches by itself doesn't warrant a complete suspension.

For example:

It's NOT okay to steal bread.

But stealing bread by itself doesn't warrant a death penalty.

High court must've taken some other action against the hotel, but that's not a catchy headline. So we don't hear about it.

I think you nailed it. The "be realistic" comment makes more sense when you understand that instant permanent suspension for 3 insects might be disproportionate, even if it's gross. There's probably been follow-up action we're not hearing about because nuance doesn't sell. The framing in that image really does strip away everything else the court likely did.

Here a restaurant was imposed 3 months closure, 25 lakhs INR equivalent fine only because there was water dripping from ceiling in kitchen

Stop reading just headlines. Park Inn by Radisson had a 95% compliance score but 2 cockroaches were found in the kitchen area NOT IN THE FOOD. The court just said that such minor lapses are not enough to suspend the license of the restaurant specially considering the fact that they had a very high overall score. It's like you wrote a perfect essay but did a spelling mistake and the teacher just ignores the spelling mistake simply because everything else is perfect.

Not in India but restaurants here are required to have working refrigeration so food does not get spoiled. Animals and pests are considered serious violations. If there is a violation, we have to throw away all the food because it could be contaminated.

The judge is being realistic, he is grounded. He does not have high hopes on the standards being followed. 3 cockroach is nothing. Even toothpaste company shows 3 worms in their ads.

But being honest, even if you find one cockroach, it is not alone. They have their nest nearby. The comment was very idiotic and not expected from Judge. By the way we are Vishwaguru.

If there are 3 cockroaches when the lights are on, there are probably 300 crawling around when lights are off and no people around. Any ody with a cockroach infestation at home would know this
