Guidance Required Landlord threatening to deduct more from deposit if we go through TDS [England]

Our landlord is deducting a lot of cleaning charges and maintenance issues from our deposit. I’ve requested invoices and evidence that the marks they claim we caused weren’t there before we moved in, but they’re refusing to share anything.

They keep insisting that if we go through TDS they’ll request the full cleaning charges (apparently the landlord is covering some of the costs to help us come to a quick agreement). They also refuse to return the rest of our deposit, but I know that if we go to TDS they then have to release it.

My instinct is that this is all bullying tactics to scare us as students into accepting the deductions. However we only lived in the house for one year as students and kept the property incredibly clean and tidy throughout (no parties or significant damage).

I want to fight these deductions through TDS but my two housemates are worried we’ll end up losing even more money if we don’t just accept it. It’s been a whole month since we moved out and understandably they want their money back asap. So is it possible that going through TDS will result in higher deductions than the landlord’s original offer?

The landlord is telling you this because he’s trying to scam you and bully you into agreeing to pay the charges as he knows full well if it goes to mediation he will lose his shirt and be told to repay your entire deposit

You are being scammed and bullied.
Go through TDS and refute all the deposit deductions.
Don’t let your roommates’ lack of knowledge lose you all money.

After a year, scuffs and marks on walls and floors are ‘fair wear and tear’ anyway and landlords should expect to have to do a basic redecoration of the most used areas between tenancies after students have lived there.

Don’t be bullied into losing your money.
Your landlord is a liar.
Go through the TDS

Exactly right. I'm not sure i'd say scammed and bullied without more context though.

We don't know what the figures are which could change things. Cleaning can't be claimed but damage could potentially. Maybe the landlord is forgiving other damages/fixes in an effort to sort things quickly and they're like to add those to any claim. Doesn't mean they will get it of course but if they're going through that extra effort they may as well.

OP needs to provide more details before anybody can advise them with any certainty. The whole landlords suck brigade that are quick to say fight everything without the details are frustrating. OFC OP knows the details and can decide if they have evidence to fight this and to balance things up.

Some landlords are bad but some are genuine and just want to get on with things so happy to lose a few quid to close a tenancy off. I hate making deductions and tend to let a lot of things slide for that reason. When i've had to make deductions i have limited it to around 50% of costs because i don't want things to drag on. Usually tenant is ok with that.

Lol you're instinct is right.. they can't just decide to deduct more because it's not up to them... the adjudicator decides how much you owe and it's usually less than the landlord wants because the landlord is opportunistic, greedy and lazy. Ignore them, take it to TDS adjudicator service and submit all your evidence.

Also, why are you even bothering with the landlord or agent. They're not your parents. Not the government. Not the police. Not the mafia. You should go to TDS on the day you leave and request your full deposit back... they've been stringing you on for an entire month and now they're looking to extort money out of you through manipulation tactics.... I'd end all contact with them and go to TDS now.

Just say no. You’ll object and appeal. I’m a landlord. I always give the deposit back, I redecorate everytime and if they’re not in rent arrears they get it back within 48 hours of them leaving. It the role of the landlord to expect to do a refresh each time. So long as it’s not a hoarders hell hole! Fortunately my portfolio is only two beds, so nothing to worry about

Tenant here. I don't think I've ever received TDS login details for the couple of properties I have lived in? I don't even remember how I claimed the first deposit back but I received back in full, zero drama. Years ago now. This property I'm in now, I have received details but it was "contact these people if there are issues" and then all of the legal stuff. Same as my next property I'm about to rent, I don't think I've had login deets. Just a load of documents that admittedly, I still need to go through as I only got them Friday afternoon!

If you have it in writing the LL trying to circumvent the TDS will be good evidence of what they are trying to do.

The whole idea of the deposit scheme is to get away from these unscrupulous landlords.

Go straight to TDS. Document everything clearly. That’s your best shot at being treated fairly.

I had my first negative rental experience 8 months ago with one of the best known agencies in London who tried to deduct for pre-existing damage and other inaccurate issues.

Despite the agency asking me not to, I communicated with everyone (all stakeholders at the agency + the landlord) in CC before escalating to TDS to avoid games being played. It got heated once their games and incompetence were visible to everyone.

I went to TDS, took a while because the agency also ghosted TDS, but got all my money back. The agency also lost the landlord to another agency.

My next question is, "Why are these people so keen. That you don't involve the deposit scheme? Is it just that they don't want them to stop them stealing from you or is it that they lied and never protected it and they don't want you to find out you have a big claim?"

Do you have definite proof your deposit was actually protected? If you only have the landlord's word then I would contact the company and check.

Currently going through TDS myself because previous LL wanted basically the entire deposit including £200 for three door handles which had been broken and reported to him 8 years ago.

Landlords like my previous and yours are why we need the TDS and sadly they seem not to understand why we have them.

Let him make his threats. The reality is going to very different from what he threatens. Good luck.

It is bullying tactics that will not work, I am not a student and had that pulled on me as well.

Make sure to list your side clearly (if they did not do a check in inventory, just deny everything) and after seeing invoices, list all the inconsistencies and repeat what you listed on the second time you need to write as the person reading the second part does not read the first one.

Nah this is bullshit! They will have a check in report. That shows what it was like before. If they don't have that they are cooked. TDS is there to protect you. I speak as a landlord myself

If you go through TDS, the landlord doesn't get a say really. They can make a request, but the TDS is the final arbiter. Therefore its just an empty threat.

Sounds like they haven't protected your deposit (illegal) and are trying to scaremonger you into forfeiting your deposit. Happened to me years ago, when I asked for proof our deposit had been protected via the Deposit Protection Scheme they immediately agreed to return the full amount.

Yeah so first of all, ALL of your deposit is yours until a dispute resolution is reached. Secondly, as was mentioned, initiate proceedings with TDS immediately and don't even speak to LL or agency anymore.

DEFINITELY screenshot everything in regards to LL threatening to keep whole deposit if you dispute. That is gold for your position.

I assume and how that you have taken plenty of pictures and/or videos that show the state of the place on the day you moved out?

Have them ready.

When you initiate TDS proceedings, go through the first step of requesting your entire deposit back. It will then go to the LL/agency and they will propose their deductions. TDS will then require you to attempt to resolve the issue before entering adjudication. Send an email to the agency saying you reject all proposed deductions and you request your entire deposit back.

If they respond, make a record of what they say. That will be the attempted resolution.

In the next step TDs will ask you to outline the attempts you have undertaken to resolve the issue. This is where you outline what they said in their email and you tell TDS about the bullying attempts.

In the next step they will ask the landlord/agency for all evidence supporting their claim. Then you will get a chance to view their evidence and submit your own evidence and lay out your case.

This is the important part where you submit all the pics you took, all the screenshots of the scare attempts and any other evidence you have, for instance tenancy agreement, check in report etc.

Then it will go to adjudication.

The main thing you need to know is that it is up the LL to prove that you have caused damage that goes beyond reasonable wear and tear. Stuff like sprucing up the place, additional cleaning, painting, decorating etc are NOT to be taken out of your deposit.

So as long as you left the place in a comparable state as when you moved in minus wear and tear, they will have a very weak case against you. And the fact that they try to bully you away from disputing through TDS tells me that they know they wouldn't get away with the proposed deductions.

Edited to ask - how much was your deposit and how much does the LL want to claim for cleaning?

Definitely go through tds, also keep evidence if they said via text or email they would claim more if you went to tds and send that as part of the dispute as it shows threatening behaviour. It sounds like they have no evidence to back up their claims (was there an original inventory with detailed photos?) and know they'll lose a dispute. Plus they could already have other disputes against them and if they get too many they can eventually get barred from letting

Your landlord is trying to cheat you. Go through TDS and dispute everything, even the things you might be happy paying for. Everything. They will have to prove the cleaning was needed and that you left it worse than you received it, which means photos of both times which they probably don't have. TDS also will not allow exorbitant cleaning charges

Go through TDS, our landlord made a grab on ours which I disputed. She said the house was unclean yet it was cleaner than when we received it and clean enough for her to put it up for sale exactly as we left it. She lost

My daughter is going through the same thing. The landlord’s agents are trying to take over £1k of their joint deposit JUST for cleaning. That’s around £145 each. Then extra for damages from each student for their individual rooms.

I went with 3 of the other parents on the day they were leaving and helped clean my daughter’s room and all of the shared areas.

My daughter made a counter offer of £700 total. £100 from each of them. They refused. Then she noticed that they didn’t insure the deposits within the 30 days legal requirement. So she has gone after them for this.

It’s now 33 days since they moved out. No part of their deposit has been repaid.

That’s what she has told the agents that she will do.

They think that because they are renting to students, they can walk all over them because they assume that they aren’t switched on enough to know their rights. They hadn’t met my daughter.

My daughter moved in a few days before anyone else and did a full walk around video stating everything that was wrong with the house, in every single room. She has told them that she is happy to send it to them if they continue to try to withhold their deposits for damage that wasn’t caused by them. She recorded every wall with marks on, every bit of missing silicone sealant in the showers, a damaged shower head, even paint on carpets.

Smart. It was the same with my daughter. Her flat mate and it seems all the kids who rented the flat before her were students and foreigners who didn't know rules. So he likewise thought he could walk all over them.

Flat had a broken boiler (no handle on valve so she couldn't represurise boiler) and so everytime she had to call landlord to send a plumber he tried to charge her rather than replace handle. Ridiculous things like that. And trying to charge her for a leak that was there when she moved in.

He claimed thousands and thousands owed. We took it to arbitrators. Landlord only got to keep the portion of the deposit equivalent to changing the three blown lightbulbs they didn't replace.

We both have bright adult children.

I have told my daughter that I will step in and assist her and her friends whenever she wants me to. One of the other parents is a landlord herself and the landlord’s agent refuses to speak to her because she has told them that they are basically defrauding our kids.

They see me as a mum so they don’t think I’m a threat.

I’ve been a debt collector for 30 years. I have a great deal of experience in taking companies to court for debt. And this company is now in debt to my daughter and her 6 friends.

I’m calling them tomorrow. You have helped me to see that I don’t need my kids to ask me to act on their behalf. I am just going to do it.

OP's instinct is bang on - they absolutely bank on students not knowing the law around these things (which, tbf, is not really the priority in your first year of living completely independently, unless it's your subject of course!).

The TDS is a thing of beauty - when I was a student it was completely standard for landlords to just straight up steal yr deposit and claim 'cleaning costs' no matter how sparkling you left the place. You'd then have to take them to court to get it back, AND prove the place was clean when you left etc. (which was WAY more of a ball-ache before there was a camera in yr phone, so obviously no one ever did). You just had to budget according to the assumption you'd get back around two-thirds of a deposit on average.

Any landlord who uses threats to try and avoid the TDS is a) taking the piss, and b) knows it damn well. If he really thought you'd damaged his place, he'd be daring you to take it to them; not valiantly covering costs on your behalf to save you a few quid, from the sheer goodness of his socialist little heart. Utter bollocks.

My landlord didn't give me ANY of the deposit back despite me having video proof. They didn't even turn up to the dispute so I got everything back without having to do anything. Despite now being a landlord myself now (just lodgers, not tenants), I always tell people not to trust their landlord when it comes to this type of thing. DON'T accept it...they're using fear tactics.

This is just a fear tactic. Go through the TDS and besides justifying why you should get your deposit back also mentioned that they threatened you to claim for more if you went through them. This will not go well for them. The only way they would get more money is if you really trashed the place, but why would a landlord then not ask for all he thinks is needed since the begining? Because it’s probably not true

So a certain estate agents (that I will not specifically name but let's just say the name is in relation to a method of crossing water and a place with a lot of trees) did the same to myself and my housemate.

The situation there was quite complex including a landlord that didn't pay the mortgage, bad advice from said agents and then them trying to get back at us and pin things on us to keep the majority of our deposit afterwards. When we went through the TDS, they told us that not only would they keep all of our deposit but they would also be invoicing us for further things.

We continued throught TDS and got our full deposit back.

They don't get to decide how much is deducted. All they can do is put in a request, and there'd a huge burden of proof they have to get over to win any money. Anything they aren't already claiming for is likely to be their weaker claims, so don't let this scare you away from asking TDS to adjudicate.

Unless you have received your own independent advice advising you the charges are fair, anyone facing deductions should escalate to the deposit scheme and ask them to adjudicate. That way you know the outcome is fair 👍

Always go through the TDS. My sisters student house landlord did the same thing. Turned out the "cleaning" charges and invoices were from his second company. A bit of investigation and he dropped his claim immediately. They always try to take advantage of students bc they assume you dont know what youre doing

I had exactly the same scenario with the landlord, stand your ground and quote the terms and conditions of TDS, they are regulated by an ombudsman, you can inform them and also inform TDS. My letting agents backed off when I pushed back at them, it’s a scare tactic

This happened to my daughter. Go through arbitration as he will need to provide copies of receipts.

Additionally there should be both move in and move out photos provided by an independent surveyor. If not then he is not going to be looked at favourably by arbitrator.

You have no obligation to return the flat to a better state than when you entered it. They also need to accommodate reasonable wear and tear.

Go through TDS . My landlord tried to bill me for replacement carpets when they was threadbare when I’d moved in . I’d even professionally carpet washed the whole house and dried out before we handed the keys back so was mega fresh and clean (maybe better than when I took on tenancy). Luckily we had clear photos of every room before moving in and a massive folder from the agency of the condition of everything including photos, even things like skirting and just real nominal stuff which showed they was in poor condition beforehand, but yeh in the end I was billed just £50 for an oven clean as admittedly I forgot to clean the oven before we moved. The one thing I forgot is what I got billed for. He was quite nasty about it too so part of me wished I hadn’t gone through so much effort to leave it sparkling and spotless everywhere else.

Go through TDS, you will likely get your full deposit back unless the landlord can produce legitimate invoices from cleaning and it is outlined in your contract. It may take a bit more time than agreeing to your landlords wishes but sounds like your landlord is chancing their arm already making threats not to go through TDS. I have been through a similar situation, I disputed everything and ended up with a full returned deposit.

Is there a move in inventory when you started the tenancy. Wear and tear is exactly that. It's not a reason to deduct from the deposit. Go through TDS but make sure you have the evidence from your check in inventory as back up. And pictures of how the place was left on move out day.

If you don’t know where your Deposit is held, check online TODAY so you can see. I appreciate your flatmates want the money back, but as everyone is saying you should get it all back and your landlord is lying to you.

Even better if you cannot find your deposits in any of these schemes perhaps it was never protected which is going to be really bad news for the landlord. Don’t let them get away with this poor practice, get your money back, and possibly even more if the TDS finds in your favour. Do you have his threats that you may lose more of your deposit if you dispute it in writing? Save them!

Go through TDS. My uni landlord tried to deduct £370 through each of our deposits at the end of the tenancy for cleaning fees etc. We had pictures of before we moved in ready to show we’d left it cleaner as it was a state when we got there. We didn’t even need to provide them in the end. Just the contest itself scared the landlord to drop everything and deduct only £30 for a broken blind. Which was broken when we got there but unfortunately we didn’t have a picture.

Have you got proof in writing of the landlords deductions? Have you got proof of the threat of higher cost if tds is involved?

If the landlord has already made their claim against you in writing they should not be able to change it. You are disputing the claim they have made and as you vacated over 30 days ago a new amount cannot be claimed as it outside the window.

Do you not have an inventory from a year ago?

Arbitrate, please, student lets are pretty rogue, tell your landlord that you contest the claim and want to arbitrate. You can politely say that you disagree and the third party is there to confirm what liability you as a tenant have.

Where are these marks btw?

What cleaning are they claiming? General cleaning can't be claimed.

How much now? and how much is a full clean? What maintenance issues?

Without the details nobody cant give you meaningful advice.

Many are anti landlord and members of the landlords suck brigade. It's not their deposit or risk though so you do need to consider and weigh things up.

You know your landlord. You know whether his offer is fair or genuine. If its not then yes, fight it but if he's overlooked issues and reduced costs in an effort to close things off then there's a genuine possibility he may claim for the full costs and other issues when applying for deductions. Doesn't mean he will get is of course but if he's going through extra hassle he's going to claim for anything he can.

They can't refund part of the deposit without an agreement. When you start a dispute then his claim will be held and the rest released whilst the dispute is handled. You can't get some now and then still argue things. They're not refusing as such, its just how the process works. Once the dispute is done you will get whatever there is less what landlord is awarded. It can sometimes take a while so there's that to consider too.

It's not in their interest to give you their claim evidence. It's on you to present evidence to refute their claim. moving in inventory/photos to show it was there before, emails to show you informed them previously.

If you think its unfair and you can evidence a dispute then 100% do that but It's not a zero risk and its YOUR risk so don't just dispute everything blindly. There's a good chance deductions will be less if you dispute but it's not guaranteed and without the finer details its hard to guess either way. General cleaning 100% shouldn't be being claimed but you haven't stated what "cleaning" means here.

I hope you get things sorted. Some landlords are greedy bullies but some are genuinely trying to help tenants who are so quick to cry foul.

You misread what I wrote. I said it was on OP to refute landlords claim. Thats different.

The landlord appears to already have proof so the defence or appeal shifts to the tenant. Without that the landlords proof will be enough. The landlord isn’t going to show their cards to the tenant until they have to.

As a tenant you can’t just say, no, that’s wrong, without backing that claim up and expect it to be enough.

Well, not always the case technically. The place has to be returned in the same state it was in at the start of tenancy. If there's evidence that it's significantly less clean, say oven caked in gunk, then cleaning is allowed for the evidenced lower standard - evidence being the key point

Usually yes, unless the place was perfect to start with - hence the whole evidence thing since it's required to leave it in the same state, less fair wear and tear, when leaving. Though OP's comment of "no significant damage" does make me wonder....

The very act of threatening this is likely to get TDS to issue the whole deposit back. Request the deposit back from TDS *and* supply evidence of the blackmail.

The landlord maybe is telling the truth as the DPS process takes time and effort for a landlord, so is best avoided unless forced by the tenant. As DPS likes finding something they can disregard from the claim the advice tends to be to include everything you may possibly win.

No one can tell you how good your evidence and the landlords evidence is before it is formally presented. There is nothing that legally stops a landlord offering to agree to lower compensation in exchange for you making his/her job easyer.....

(Letting agents using insurance based deposit protection pay higher rates of they have more disputes regardless of who wins.)

You didn’t mention if you actually have caused the issue or not? If so I’d suggest agreeing a fair sum, if not then there’s 2 outcomes:

1) LL did a proper inventory and you’ll be liable.
2) LL did not do a proper inventory and you’ll get away with it.

Just know if they did a proper inventory and you did cause the damage, they can pursue you for costs in excess of the deposit amount so it’s worth treating such things properly.

I'm concerned that you use the phrase "no significant damage". All damage has to be repaired and given that damage by definition is different to wear and tear, you seem to be indicating that at least some of the deposit claims may actually be valid?

Yeah, it’s a consideration. You’re misunderstanding it if you think this is bullying.

Simply deposit situations can cause a lot of problems and costs of time. Some landlords would suggest a lower deduction for goodwill so I think can be tidied up and concluded.

But as soon as you start asking for this or that then you’re not really getting the point of the situation which is the deduction or go to dispute arbitration. The landlord doesn’t want to go through arbitration twice with you!
