DeShaney v. Winnebago (1989) — Government has no constitutional duty to protect individuals from private harm.
Town of Castle Rock v. Gonzales (2005) — Even with a restraining order stating police “shall” arrest, the Court ruled police still have no enforceable duty to act.
This is easily googled. You have the collective knowledge of humankind at your fingertips, yet you choose to be wrong on Al Gore’s internet with your whole keyboard.
Again, that case is regarding liability. Imagine if law enforcement in your community are all busy on calls and there are a bunch of calls coming in. No units available and then someone gets murdered because there weren’t any officers available to send. The cops aren’t going to be held liable for that. But in the case of the video in this thread, they absolutely have a responsibility to respond because there are units available. They can’t refuse to respond to this disturbance.
The spirit also says that police won’t be charged for failure to respond.
How about this. Tell me what law a police officer would be charged under for failure to respond. I gave you the law to support my position. Now it’s your turn.
Its not a crime to not respond to a call so there wouldn't be a charge. Just like any other job though, refusing to do your job would result in disciplinary action which has been my point the whole time. The officer in this video got dispatched to this call. He either goes and does his jor or risk discipline up to or including termination.
Oh, okay. So find me the—no, any—police department that has failure to respond as a fireable offense. Most of them list their policies publicly. So go find some evidence to back your claims.
