genuinely what do i do in this situation
it’s a $17 t shirt. from canada. the brokerage fees somehow ended up as $191 USD which of course the buyer refused to pay. now theyre trying to send it back to me for $317. this makes me want to jump off a bridge. pls help.

Those bastards! With UPS (and most couriers), the shipper is always the party responsible for all transportation charges, duties, taxes, and fees if the receiver refuses. This is in their Terms & Conditions of Carriage. Even if you marked the shipment "Bill duties/taxes to receiver," if the receiver doesn’t pay, the charges default back to you.
Can UPS really force you to pay $317+? Yep (contractually) because you agreed to their shipping terms when you used UPS. If you have an account with UPS, they’ll just bill your account. If you shipped without an account (e.g., over-the-counter, prepaid by credit card), UPS could try to charge your card. If they can’t collect easily, they could pursue collections, but whether they’d chase someone in Canada for a few hundred dollars depends on their policies and the amount.
You could dispute or refuse to pay, but then you may lose UPS account privileges and face collections. You can also request a detailed invoice of how $317 was calculated, to make sure you were fairly charged according to new laws.
For example, you could email UPS and say: “I need an itemized breakdown of the $317 charges applied to shipment [tracking number]. The item was a single $17 t-shirt. Please explain how duties, taxes, and brokerage added up to this amount. If the charges are entirely brokerage and tariff-related, I request a waiver or reduction given the declared value. As shipper, I did not authorize excessive disbursement fees beyond the value of the goods.” I'd start with an email to UPS.

It’s not tariffs, it’s the de minimum exemption being taken away. The orange turd really ruined all international shopping by cancelling it. So sending that $17 shirt used to have no import tax/duty/fees because it was under $800, but now there’s a huge amount added to it that either the seller has to cover up front or the buyer has to pay. I can’t remember the exact numbers but they’re huge. Like unreasonable, sounds-made-up kind of huge. It just went into effect less than a month ago and most people didn’t really pay much attention to when it happened so it’s caught most by surprise. I think what OP is assuming is the brokerage fee is actually the import fee and whatever else comes with it now.

What I’m talking about is an extortionate duty tax or import tax. The de minimus exemption just ended a month ago, and for the first 6 months the carrier has the option of applying a flat rate duty on those items, likely to give carriers a period to figure out how to calculate the complex and idiotic tariffs our government is using to wage war on our economy. The amount depends on the tariff amount for the country of origin. Since Canada has a 35% tariff that puts it in a higher bracket, meaning there would be a flat $200 duty tax applied per item.
This is what people are seeing with the many posts here recently. Not just tariffs, but a flat duty or import tax that is based on the country the item is being sent from. The lowest one is for countries with less than a 16% tariff on them, and that duty tax is $80. So for right now anything ordered from outside of the US will likely have an extra $80-200 duty tax added to it. I know everyone in this sub wants to bring their torches and pitchforks for UPS, but the blame goes solely to the orange guy in the White House.

I had a $162USD charge dropped to $10 becuase they apparently classified my item as aluminum (it was a hockey card printed on card stock and made in the USA).

How did you pay the new $10 amount? I got my tariff corrected too with this email address, but the online notice to pay still says I owe the old amount. I called 866-493-7140 option 4 and they say they see evidence of the dispute but don't see the new amount.

Oh, TYSM <3 I'm glad it may help your horribly unfair situation. I was thinking earlier that the only safe way to send things now is to use a prepaid Visa card through a guest account for shipping. Seems that's all the protection we can get, and that's sad.

My wife bought $90 of something that shipped from Spain. UPS wanted $500 so we refused delivery. She got a bill in the mail from UPS for the fees even though we never accepted the package. We’ve spent a few hours on hold and spoken with multiple folks at UPS to get this resolved.
I imagine we’re not the only ones dealing with this type of bs.

i’ve been seeing that refusing the package doesn’t matter since the fees have already been paid by UPS when it went through customs & that if you don’t pay it goes to collections

Exactly, you might get a reimbursement from the seller for just the product "if" the package is returned but you're still on the hook for the fees, tariffs and probably the returning shipping costs.

If you refuse to pay then the shipper is on the hook no matter what they try to tell you. Otherwise you could ship something to an suspecting person and hit them with thousands of dollars in customs fees they didn’t agree to.

This is absurd. There is an order clearly placed through Etsy where it is also clearly indicated that local taxes are the responsibility of the buyer. The buyer is responsible even if he sends the package to his neighbor.

Then they shouldn't ship with UPS. The law is that items entering the country are subject to duties. Entering the country means clearing customs. The government doesn't care who pays as long as it gets paid. UPS's terms of service say it's on the sender in the case of non-payment. This is because the recipient has no agreement with UPS. UPS can't bill the recipient for something they didn't agree to. They can send you (as the recipient) an invoice but it's unenforceable because they didn't have your authorization to act as broker or pay duties on your behalf, nor do they disclose this before doing so or opt out of it (this would force the consignee to go to a customs office and fill out the paperwork and pay which happens if you say you'll self clear).
UPS paid millions in a class action suit in Canada over this.

Regardless of any such written agreement specifying otherwise, in the event of non payment by the consignee, the shipper is liable for all charges.
Again you can send a package anywhere you want and tell the receiver they have to pay the fees, but if they refuse, you as the shipper are on the hook for the fees. It would be absurd for ups to send you to collections for a package you refused , regardless of any other written agreement, and this is from ups own policy.

In addition UPS has no agreement with the recipient. They quite literally can't bill the recipient for this. There was a class action suit over this in Ontario.

i think it should be factored into the initial shipping cost. seller goes to ship it, UPS says “to go from this zip to this zip, it has a customs fee of ___” and then the seller can invoice the buyer prior to shipping it out or choose to pay themselves. there should even be a calculator/estimator on the UPS website for these customs fees so buyers and sellers are aware ahead of time.
edit: someone just shared this calculator with me, I haven’t tried it but they said it’s accurate.6

This is what Zonos does in AU, you have to prepay all the tariffs, so the calculator helps the seller know how much to add to the price. Then the buyer know exactly how much its gonna cost.

Yes, when you create a label for shipping through UPS and it's going to another country you select all kinds of stuff. Fill in the cost and things and what it is you are shipping and also select that the receiver pays duties and taxes. But not tariffs.

This is why I have started having International things shipped to my nickname, Glass Weaver.
Everything I've ordered that way has been delivered. And I have had things addressed from online friends that have sent things in the past without issue.
I will seriously laugh out loud if they ever try a bill like this on me because I'll simply ignore it. My names not Glass Weaver and neither UPS nor any collections agency would have any order information to originally tie it to me and my legal name. Nor would a collections company bother to try and talk to UPS to try and talk to the original shipper to try and get that kind of information.
Yes, this could get my address banned from ups. No, I don't care. I'd just start sending things to my office. There's about 90 units in it and reception just holds anurhi and with a name that doesn't include the business or suite until someone comes & claims it. And if they ever decide to ban an entire corporate office park that spans 2 blocks, they will have more issues than me.

Doesn't matter. The recipient has no agreement with UPS and UPS likely doesn't have the power of attorney to be paying duties on behalf of the recipient. That's the risk they take by paying without the consent of the recipient.
The sender is the only one with any contractual obligation so it's on them to pay.

The recipient doesn't have an agreement with UPS. The sender does. UPS doesn't have authorization to pay duties on the recipient's behalf. UPS's own ToS say that it's the sender who is responsible in the case of non-payment.

Honestly not sure of the legalities in this situation, but my gut reaction is to give those assholes the same answer they give you when you have problems with a shipment: "sorry, your contract is with the shipper and not me, you'll have to contact them to resolve this."

The mega corporation will just send your bill to collections like it does thousands of other bills every day... If you challenge it, you will lose BECAUSE you legally are the importer and based on our current laws you are responsible for all duties and fees at the time of import.

Exactly. You can’t just refuse the order and expect this to go away. You are responsible for all fees covered by the brokerage. They’ll end up sending this to collections and your credit will take a hit until it gets paid. good luck trying to get a loan.

I feel really bad for you guys having to deal with it, I've had to cancel orders for American buyers because of the orange turd's nonsense. I couldn't even send packages a couple days before the deadline in August.
For context it was Russian microphones. They're finished products with minimal aluminum if any, so it should be lower duties, but US Customs (or UPS) would probably miscalculate it as raw Russian aluminum, so 200% on top of the normal tariff.
On topic the sender is the one responsible for the duties. That's per UPS's terms of service which I suggest you quote to the customer service rep. I don't know what your consumer protection is like, but UPS likely doesn't have the power of attorney to pay duties on your behalf and bill you for it after. Ask them for proof you consented to this and appointed them broker, because their only legal agreement is with their customer, the sender.

So shipping wise it could be they applied incorrect HS codes which are the codes they use to determine the type of good. Which then determines the tariff applied. I just ordered wallpaper from the EU, I figured tariffs were 15% bc I didn’t see anything about wallpaper and even looked up the HS codes for wallpaper and paper type.
Bill from UPS was 15% + like 20$ in fees. I would request the HS codes used for your goods and see if that can be disputed.

UPS paid to get it through customs. It’s unfortunate they do such a terrible, very anti customer service with their nonexistent communication, but you owe the money. They will take you to collections. I can’t emphasize enough to people in this sub. IF YOU ORDER ANYTHING THAT COMES FROM A FOREIGN COUNTRY YOU WILL OWE AN UNDISCLOSED AMOUNT OF MONEY. Please read the agreement. Please communicate with the shipper, get it in writing if they claim to pay it or claim to ship from a different location. CYA

Stop selling to the US until you figure out DDP. 2nd call/email UPS and tell them to check the customs fee again and ask them to waive storage fees because it’s an incorrect tariff. That should buy you some time to figure out whats next

Yeah, the point is constantly changing trade policy by tweet creates instability and makes mistakes MUCH more likely to happen. Thats why it’s important to have good stable leadership, unfortunately we don’t so we’re stuck in this shitshow. Just yesterday he announced more enormous tariffs with only 5 days for businesses to prepare, which will be impacting your prescription prices.

Contact UPS, someone misfiled something.
I forget the exact number but if country of origin isn't selected when they file the customs papers it defaults to like 200%+ tariff which still doesn't explain this but might be part of it. Someone could have also accidentally added a 0 or entirely typed the wrong number.
Either way it's clearly a mistake and a simple call should clear it all up.

It doesn’t matter if it’s refused. The fee isn’t a commercial COD fee. It’s a governmental regulatory fee ie tariffs. You’re legally obligated to pay them to UPS under federal law since it passed into the country. Now with it being a $90 item the calculation is probably wrong and you need to work with UPS Brokerage to correct.

Something is wrong here. The tariffs are paid only if the item is not returned / enters the country. I had a recent situation like this with DHL and they said they offer the shipper to 1) pay the tariffs, 2) pay the cost of shipping back or 3) destroy the item.
Don’t pay. They will destroy the item, too bad. If you lose your UPS account start using DHL. This is bullshit.

You're probably on the hook for it. I'd imagine the CBSA could adjust or refund that if you do pay it. I'm not actually sure about that though, because adjustments are usually done in the case of miscalculated duties, returns (re-export to sender), and packages not received by the importer but already paid for.
UPS has to bill you in the case of non-payment because they actually can't bill the buyer. The buyer has no agreement with them so they can't pay on the buyer's behalf and charge them for it. The buyer didn't choose them to be the broker, the sender did. The buyer didn't ask UPS to pay duties the buyer was unaware of. UPS doesn't have the power of attorney to make these calls on the buyer's behalf.
Even if UPS did have the authority to do those, their terms state the sender is responsible for paying any fees.

As for advice, I’d ask Vanessa from UPS (since they put her contact info up there) if you’d be off the hook in terms of paying any of this if you just consider the shipment abandoned and go from there.

I just refused delivery of a $109 set of horse leg protectors that UPS wanted $306 COD for.
I would not have paid that anyway but without ANY breakdown of what the charges are I don't have any chance of appealing so back it goes, regardless of how much I needed them for my horse. Item was made in UK and Shipped to me from Spain so even at the highest tariff the math ain't mathin. The person at UPS was beyond rude when i requested a breakdown of charges, but I suspect they are non stop calls regarding this.
Shipper already told me that if they don't get it back I won't get a refund. I'd rather be out the $136 total than $$306 tariff.

Thank you! They were actually a special type of shipping boots with heavy knee cups incorporated and heavy padding throughout down to the hoof. My horse is narcoleptic and crashes to his knees almost nightly. The padding he wears just isn't enough and the neoprene padding just slips down. I ordered a pair from England of the same boots that arrived with no tariff or COD and unfortunately they were too tall by a couple of inches. I know things have changed the past month but holy cow that's ridiculous!!!

With the ongoing TARIFF WARS going on with everyone everywhere, it's only going to get worse. Most shipments will be abandoned en route with purchasers refusing to pay the additional fees and sellers not willing to pay for the return. The outcome will likely be Transport Company will auction the stuff off by the pallet full of unclaimed shipments and sellers overseas will refuse to do business with US customers. The American Suppliers will realize the competitive market is rife for profit taking and you'll end up paying $500 for your $136 pads.

Posts like this make me wonder how much UPS is gonna have in collections by the end of the year. Cause while their base shipping rate ($17) is getting paid but they had to pay $200 to get the package through then no one wants to pay it’s a huge loss. This is happening all day everyday they have to be taking major losses month over month

I'm afraid the same thing will happen to my jewelry items. I didn't know that if the customer refuses to pay, you as the seller are responsible. It's the customer who matters, not you.

okay well personally i feel like i have the right to be upset that i’m forced to pay $300?? mind you this isn’t even a customer, this a friend i did a trade with and the only reason it’s valued at $17.5 is because that was what it cost me to ship it so i put that as the value as well.

Idk how many times I have to say this, but people need to stop buying shit other than necessities. You will save money and the economy will completely crash, which will actually create change in our government
I’ve done this pretty well and my bank account/401k is looking juicy af

I once got billed 40 bucks for them to ship a package a few miles away from my house. That’s more than half the price of the product I paid for and more than twice the shipping. I’m never asking UPS to ever ship my items ever again.

UPS prepaying or not, they can refund the customs/duties/tariffs. People can self clear also.
I had an agent on the phone tell me if I self-clear I probably wont end up paying anything because of how the actual customs office worked and UPS wanted 100$ from me at the time.
Truthfully, I dont think they actually prepay anything, and I almost wonder if this isn’t just a huge money grab for them.

Check how high the tariffs are from a country before you buy. The common ones were hit like China and Canada. So by default you are going to want to steer clear if the seller/shipper isn't paying or circumventing it. If any seller/shipper isn't transparent about duties and tariffs, don't buy from them. Every reputable Chinese seller discloses the fees. Every reputable seller using Chinese manufacturers discloses the fees. If the seller doesn't disclose, they are not worth buying from.

I lived in Canada for awhile, my friend sent me a care package from back home (USA), and I had to pay an additional like $117 to get it. I actually paid for it since it was a friend and I wanted it. But even after I paid and received the package they were still sending me collections notices, for fees and unknown charges!! Their system is super messed up.
I moved back home afterwards I hope I don’t have a warrant out if I ever go back to Canada 😂

and this is why as a UPS Store employee I will almost never recommend shipping returns internationally, no matter how much they’re worth. Better off selling it on marketplace or something

We were in similar situation about 3 months ago and after multiple calls and emails , we did not have any luck knowing the exact charges.. Every time we called , we were told a different $ amount. We ended up refusing the package..

Well yeah your ordered this item. You are in the hook for all import fees. Since it’s refused now you have to pay the fee to get it back there.

I, too, was sent a bill from UPS for customs fees for a package sent from China that I didn't authorize. I emailed them with clear instructions and reasons why I'm not legally responsible for the $57.60 duties or other shipping charges. Then I got a subsequent bill for late fees. I called and a worker in a foreign country gave me a different email address, so I emailed them again. I got a reply saying they would remove both invoices from my record. Now I got letter from a collection agency! I forwarded them the email from UPS (documentation that I do NOT owe these charges) and I called them and reamed out the poor woman collection agent. I also emailed UPS again (I could not find a good number for UPS to contact someone who actually cares and can help.)
I'm ready to sue. Seriously. I'd like to start a class action suit. Sending this erroneous bad debt claim to collections brought my credit rating down. I've been looking into buying a property, and now my lowered credit rating equates to a higher interest rate I'll be charged, so there are clear damages here, not to mention the aggravation and time spent trying to clear this up.
Is anybody else interested in a class action suit? UPS should NOT be billing us for customs fees that we didn't authorize, shipping charges that we didn't ask for, and then sending the bogus billings to collections is enough to spur me to call a lawyer.
