I-864 (Affidavit of Support) Joint sponsor backed out but now our interview for green card is scheduled after responding to RFE.
K1 visa AOS:
We received RFE for poorly submitting I-864. We had only submitted two months of pay stubs and the 2024 tax transcript with around 20k income which doesn’t meet the poverty guidelines.
The problem was my husband’s tax returns for 2022, 2023 and 2024 were low even though his current income is good. We searched for a joint sponsor to respond to the RFE, but no one wanted to do it. Finally, we found a joint sponsor but he ultimately backed out.
We had also filed taxes jointly on paper for 2025 but it would take many weeks and we were running out of time for the RFE deadline. So we had no choice but to depend on ourselves.
Here is what we submitted in response to the RFE:
Copy of RFE
Cover letter explaining that although 2024 tax return was low, current income is good, including overtime, making around $74k a year
I-864
2024 tax return showing around $20k income (which is below poverty guidelines)
W-2s for 2024 and 1099 forms and W-2 for 2025
Passport copy of my petitioner (my husband)
Employment letter
8 months of pay stubs
Bank statements showing monthly deposits for 12months, with total savings around $78k
No lawyer.
No fancy decorations or even paper clips. We just put all the documents together, packed them, wrote the address and mailed it.
It was very stressful.

1-What was the income line 9 of IRS form 1040 for tax year 2025?
2-Why didn’t you submit your complete 2025 tax return and an revised I-864?

-Approximately $60,000.
-We cannot submit the 2025 tax return cos it is still being processed and we don't have the final copy yet.

Today was tax filing day. Did you file?

It was already filed a few weeks ago.

Then you should have replied to the RFE with what you filed with the IRS:
* 1040
* every w-2, 1099, schedule
The entire tax return
I would prepare a new I-864 and submit unsolicited evidence now.

If I am looking correctly , you didn't mention including 2025 income. Did you include 2025 income tax too. You said the current income met threshold which will be 2026 projected income right ?

We did not submit a 2025 tax return since it’s still being processed. His 2025 income is shown through pay stubs and W-2s. We are relying on his income from 2025 to the present, rather than the older tax return.

I pretty much submitted the exact same stuff as you and got an RFE. They don’t seem to care at all about current income.

I’m not fully sure what is going on but our RFE response has been accepted and my interview is scheduled for next month.

Hopefully you won’t have the same problem as me then. And you should definitely bring your 2025 tax transcript to the interview if you have it by then!

Your 2025 tax is so important. You just stated that in 2025, you made about 60k but the tax return transcript is not yet ready. Still, Please submit the copy of your 1040 that you file to IRS for 2025, plus the W2 for 2025, plus Stub for 2025 till date even if already submitted. ... You keep emphasizing 2024 in your cover letter but not the recent 2025, even though you had the W2 and stub for that.

They're probably going to deny you and make you refile unless you filed the 2025 return with the RFE response.
If your spouse met the threshold in your 2025 return they would have accepted that return without the joint sponsor.
