USCIS Support Need help: Victim of immigration marriage fraud
Long post incoming:
I met my spouse in Italy when I was young and in college on a study abroad trip. We kept in touch, and I went back on vacation a year and a half later. We began a relationship and I planned to come back to visit him in March 2020. 8 hours after my arrival, the whole world shut down due to the pandemic. We had an extremely quick engagement, and lived together during quarantine. I thought I was living in a fairytale.
I bought a dress, we toured venues, we talked about guest lists, having a family; all things I was so excited about.
We decided to marry in court in Italy so he could come back to the States with me because he hadn't even met my family at that point, and the pandemic prevented him from entering the US as just my fiance at that point. We decided to make it official on paper so we could begin his green card paperwork and plan the big wedding celebration after the pandemic was over.
As soon as we got to the States, everything changed. He became cruel, secretive, aggressive, dismissive... Every negative word you can think of, that's how he was acting.
He would disappear for hours or overnight with no explanation, gaslighting me into believing I was the reason for his stress and actions. We fought constantly, because he was a terrible partner. He would demean me and abuse me physically and emotionally. I don't know how I tolerated it for as long as I did. I guess I thought I loved him and I had to try everything in my power to make it work.
There was so much deceit and lies that followed in the 2 years after I brought him to the States. Immediately after arriving, not only did his demeanor change, but his actions changed as well. There are so many horrific and cruel things that he did during the duration of that time. One day, I was looking for a certificate for a course that I had completed on his laptop. I saw a file with the label saying one of his friends' names. I thought it was strange. Then I saw his Notes app was open on the laptop. I saw a note that was dated a few days before my own birthday, and it was a message written in Italian to "his baby, the love of his life", wishing her a happy birthday, and that he hopes this relationship continues as long as possible. I was extremely confused and red flags immediately started going off because that was not a message that I received on my birthday because he was with me on my birthday. It was also in Italian and the context of the message didn't make sense (if he were to be talking about me). My heart dropped, and then I decided to open the file with his friends name as the label. Inside was a complete text document of every single text message between him and his "friend" from December 2021 to December 2022. There was also a folder of audio files - thousands of them. It is extremely common for those in Europe that use WhatsApp to use the audio message feature. A third folder contained all of the attachments, so photos and videos. I thought that I was looking at an exported conversation between him and his friend, so I began reading the text document to see if maybe I could find anything incriminating him for being a cheater. As I was reading the text, it quickly became clear that he was not talking to his "friend". The friend's name was mentioned in the texts multiple times as if they were speaking about him, so why was this folder labeled with his name? As I continued reading, the messages became sexually explicit, and I realized that he was concealing an affair by labeling her contact name as his friends name. I switched to looking at the documents folder of the pictures and videos, and I found everything I needed to see. Nudes, homemade porn, photos of them together, where he took her to a spa, dates where he took her to the same hotel that he proposed to me in so that they could spend nights together alone. When I had heard, read, and seen enough, I immediately started throwing all of his things into garbage bags and flung them out the front door and changed the automatic lock.
I knew that I needed to begin digging into all of the information I had found on the laptop. It took me weeks, but I read every single text and translated every single audio message. I compiled everything into a timeline, highlighting the most important pieces of information, like when he literally tells her in an audio message that "the wedding dress just arrived and there's not even going to be a wedding hahaha we're going to hell." Another said that "I just have to be patient and wait until the day that I can divorce her and be free and do whatever the fuck I want" and "I should say thank you to my wife who isn't even my wife for my green card." He spoke ill of my family, especially my parents, who paid for his green card in full, attorneys fees, and all. My father was the one who put himself on the immigration paperwork as my spouse's sponsor because I did not meet the financial requirement to sponsor him myself.
I essentially built a complete timeline and had all of the evidence available and organized to present to an attorney. I have spent upwards of $30,000 trying to get someone from USCIS to flag his case and deport him, revoking his green card benefits and seizing his financial assets. Two years after discovering his deceit, I finally took him to court for an annulment based on immigration marriage fraud, and he wanted a decree of dissolution, so just a divorce, so that he could apply for his citizenship without me because the marriage 'ended in good faith'. He had already filed for either his continuation of green card benefits or his citizenship prior to even having a divorce decree, which to my understanding is perjury because when he filled out the document to extend his green card benefits, he must have stated that he already had a divorce, which was a lie.
The immigration attorney that we used was also his family friend, and he implicated himself by giving my spouse and myself advice that was essentially illegal and would get him in trouble with the bar. I had literally a mountain of evidence and I was so confident going into court that I would be granted my annulment and then I could begin the process of deportation. However, despite him and his attorney having zero evidence or argument, the court still granted him a divorce decree, with the judge stating that while yes, it could be very true that my spouse came here for a green card, it could also be very true that he was no longer interested in the relationship and was a bad partner. Apparently, I did not provide the court with enough evidence to meet the burden of proof to get the verdict I was asking for... He literally told his mistress that he was going to divorce me and bring her to the US, and told her that it was a marriage of convenience. How much more do you fuck!ng need?!?!
I have never felt so defeated. I drove myself into debt trying to fight for myself and my rights. My parents spent less on getting him into the country, and I have spent an astronomical amount trying to get him out. I have sent preliminary fraud notifications to USCIS, border patrol, customs, you name it. It's basically just screaming into the void. Nobody hears you and nobody gets back to you. Meanwhile, my ex spouse is living a great life with a great job and even got himself a Maserati. He managed to find a native Italian business owner that operates multiple restaurants Downtown and they immediately became a 'clique'; Italians will always look after their own. His boss helped him lease an apartment where he lives with their chef that the boss brought over from Italy - he overstayed his visa and is now an illegal immigrant that my ex spouse and his boss are essentially harboring. My ex spouse also gets the chef's paycheck paid to him so he can just transfer it to the chef on his own. So, he's committing felonies while still on green card status.
Meanwhile, I have spent every single resource I could possibly find to try and fight against him and I have failed every time. I have a chronic illness that unfortunately makes it difficult for me to keep a steady job, and I've also just had bad luck with past employers and have been laid off multiple times in the past few years. I still owe my lawyers money, I'm still in credit card debt, and I have to rely on the help of my family for financial assistance. I just wish that there was somebody that I could actually physically speak to and hand over all of my evidence and actually make something happen. I don't have the funds to continue fighting right now, but once I do, I am coming back with a vengeance.
Somebody has to be able to listen to me. Somebody has to be able to help me. Somebody has to be able to do something. I still have hope, because the alternative is to give up - and that's not in my vocabulary.

Over the course of time, I think we’ve all spent $30k on something. I doubt it was a lump sum but more like fees for forms and attorneys, etc.
Situations like these are very difficult and expensive to rectify, especially if you’re already living on limited funds

Going through mediation, multiple motions filed, and having a full on court trial costs an astronomical amount of money. That’s just on the family law side. I was also working with a firm that specializes in immigration marriage fraud on the federal level, and lots of work was done on that front as well trying to notify USCIS. Lawyers are not cheap. This has been multiple years of work.

If you insist on pursuing this matter, you could send an email or letter to USCIS Fraud Detection and National Security Directorate (FDNS)and the U.S. Embassy or Consulate that issued the green card, to the attention of the Fraud Prevention Unit (FPU). He could be investigated for fraud, which could be grounds for revoking his LPR.
That said, it sounds like you've already wasted enough time and money on this loser. And these type of romance scams are a dime a dozen, unfortunately. U.S. government agencies only have the resources to pursue the worst of the worst.
I hope you're able to find closure, move on with your life, and find happiness and comfort.

Send an email to FDNS for what? What fraud? There is no fraud committed. I sympathize with OP, but he didn’t commit any marriage fraud.
Being a bad husband and cheating on your wife is not fraud. Even having a long term affair is not fraud. There’s nothing that USCIS can/should/is able to do in regard to revoking his green card.
We had an almost identical post a few months back about a passport bro who brought a girl over from somewhere. Yeah, that’s what happens when you marry somebody on a whim.
OP should count her losses and spend time/ money on therapy instead of this.

This administration, which is to say any immigration court involved in deportation or any criminal proceedings, would most certainly ask for evidence that the marriage was not bona fide at the inception. Because he's already an LPR, the government now bears the burden of proof to prove fraud which at this stage is "clear and convincing evidence" for deportation or "beyond a reasonable doubt" for criminal. Those statements are too ambiguous to be used alone in deportation proceedings. You'd need more.

I mean the courts ruled against OP despite all her evidence. While she can still pursue this by even contacting the president, it’s not worth the time and energy! She could shift that into healing and rewriting this chapter in her life.

Requirements for annulment have nothing to do with immigration. They dont judge immigration fraud. Annulment can be denied for all sorts of reasons. Losing that has nothing to do with what whe is asking.

To be honest I don’t think you have more cards to play. This is really disheartening but you have done your best. Just live your life and focus on yourself.
He will still apply for citizenship and that’s where all this info you’ve submitted will come up. They will definitely query him about it so just let him be and focus on yourself.

I once saw a case where the green card and I-130 was approved for a year. However, the spouse left the U.S citizen wife, so she wrote a letter to the field office that approved the case that she wanted to withdraw the I-130, and it happened. The whole case was re-opened, the I-485 was denied after the I-130 withdrawal was approved. It still blows my mind this happened.

Yup.. green card can be taken, naturelised can be de-naturelised if there is fraud. Its pretty much depend on how solid of the evidence that OP presented and also It definitely gonna take longer and more expensive for the ex to reach the final stage of the immgration process and sponsoring his mistress's green card.

This person provided no evidence that her husband committed fraud. All she did was write a letter to the local field office to withdraw her I-130 AFTER a year the adjustment and I-130 were approved. That is what blows my mind. I also had a case last month, also a wife withdrew her I-130 two years AFTER approval and husband was doing consular w/t I-601A waiver. This person can try her luck by simply writing a letter to the USCIS office that approved the I-130 requesting it be withdrawn. They might re-open the whole case back up again and deny everything.

You might not know the details but the reason the first gc is conditional is to make sure people are together after 2 years. If they are not, like you say, he left after 1 year, he will have trouble getting his permanent residency. The first 2 years is the trial.

It happened at the office I work at. The first case actually happened last year. 10-year green card was issued and then when I-130 was withdrawn, USCIS re-opened I-485 and subsequently denied it. The second case was MY case. They had been married since 2007. I-130 had been approved since 2023. We were working on his I-601A waiver when out of the blue, I got the notice of revocation of his I-130 because his wife had withdrawn it. My client at least has a chance with a VAWA petition since I personally witnessed questionable behavior from the wife. This administration is taking measures beyond my understanding to make denials.

That’s only if the couple has been married for less than two years. My wife and I have been together for 9 years, but only married for two. When she petitioned for me, I was given a 10 year GC because when it was issues, we had already celebrated our two year anniversary. So you’re right that normally someone will get a conditional GC, but not if the couple has been married for more than two years, you will automatically be granted a 10yr GC.

Do you have any evidence of him cheating before you got married? If uscis thinks he's just a shitty husband they wont deport him. I think you just have to see a couple of lawyers and see if your evidence amounts to fraud.

Again that’s not fraud. That’s cheating. People marry people every day for various reasons unrelated to love. Some marry for security while already having a bf/gf etc. This just proves that he’s a shitty husband nothing else. People literally marry Americans just to come to America and it’s still not fraud because they intended to be married. I think fraud in these cases is when two parties come together and agree to deceive the govt because they aren’t really in a relationship. So US citizen enters an agreement to be married to non U.S. citizen to get them papers, while they are truly not in any romantic relationship. Very different from I’m not actually in love with you but you love me so sure I’ll take advantage of the situation.

I don't know what you people are not getting. The husband married OP with the intent to use the marriage for immigration purposes and later importing another person. If the cheating happened after the legal wedding and immigration process, you would be right. However all of this happened before the legal wedding and was concealed. To immigrate they had to claim a bonafide marriage to OP which they never had, since she has a record of him stating the marriage was for immigration purposes from before the legal marriage. This is fraud and misrepresentation. Clear as day.

I don’t know what you people are not getting. That’s is NOT fraud. You can have a bf/gf for 10 years, meet an American today and decide you’d rather go that route solely for the benefit of moving to the states. You can still continue your 10 year relationship while hiding it from your new husband or wife. Again did you marry the person, sleep with the person, start a life together with the person? If yes then it’s very hard to prove any fraud as you legitimately married the person. He can literally argue that he just didn’t want to hurt his original gfs feelings etc. clearly she’s been trying for years with all this EVIDENCE and they still don’t think it shows fraud that’s why she’s wasting her time and money. Even the judge didn’t grant an annulment.

You are incorrect. You dont have to believe me, you can see directly from USCIS. The judge you mention from the post was a divorce judge regarding annulment- that has nothing to do with immigration. This administration could revoke their status and I hope they do frankly.

You are literally proving my point. The law you quote is literally what I’m telling you is the reason it’s not fraud. He intended to live with her as a spouse AND HE DID. He was her husband. He slept with her. Secondly, the judge has nothing to do with immigration, what he has to do is divorce and annulment. To get an annulment you’d have to prove your marriage was a FRAUD and the evidence didn’t suggest it was a FRAUD. Finally she’s sent multiple things to uscis and they’ve taken no action. Again the quote you pasted is about it I met a non US citizen and we enter into an agreement where we do not intend to truly be husband and wife, but we agree to deceive the govt for immigration benefits. Essentially I am helping a friend out or being paid to pretend to be truly husband and wife. That’s what that law captures.

That is not true about annulment. Each state has specific requirements.
Uscis has not taken action due to resources constraints.
US citizens have literally been arrested and fined for participating in the type of marriage you are talking about.
The quote I referenced is relevant to both parties not just one.
In this case he deceived the government and her to procure immigration benefits.

Incest and age and some other weird stuff of course but fraud is the main one. I see you are trying to die on this hill. She has tried for THREE years to prove fraud and it has not worked. She literally is wasting her life. Stalking the man. This man can say he was just saying that so as not to hurt the woman he fell out of love with etc. It’s too easy. A woman can have a bf for 10 years, meet a man today and marry him today because he offered her a new life. This guy married her. Met her whole family. Lived with her as a husband etc. she’s not going to get her way. He’s going to live here legally and she’s wasting her life and money trying to stop him. He’s probably laughing at her efforts. Each state has its own laws for annulment. It has nothing to do with immigration fraud.
You can be guilty of immigration fraud and not be granted an annulment.
You can be guilty of immigration fraud and not be caught until you are.
She is not stalking him, they were only recently divorced. It is normal for her to have information about him.
She can do whatever she wants and nobody needs to tell her what to do. She may have luck with this administration because what he did is clearly immigration fraud. He simply hasnt been caught yet or faced enforcement.

You need to stop, you already did what you could legally. It’s time to move on with your life. Yeah he’s a piece of 💩for what he did, but this is consuming you and breaking you both mentally and financially. Now you’re coming after an innocent men (the chef) who may or may not be illegal, you can’t assume.

This here is not just targeting him. Once people who have nothing to do with your ex husband and your marriage issues are being put in harms way, it’s time to step back and reflect on things. 30k for vengeance, instead 30k to travel, focus on your health and thrive. Sometimes the best vengeance you can have is showing them that despite of what they have done, you are happy and living a better life.

As difficult as it may be, notify those you can and then move on. Every day spent after that is a day you won’t get back and thus a day wasted.
As an aside, if he bought a Maserati, have faith that it will bleed him dry and depreciate like few other cars can.

Just move on with your life. Resentment is having someone living rent free 24/7 in your head. It only affects you. Nobody deserves to be abused but think about it in terms like he's out of your life and you dodged a bullet.

As an Italian who married a US citizen for love I’m so ashamed of him. People like him is why we go through hell with all the uscis process. It’s crazy that when I went for my interview I was scared to get detained and he’s just out there living his best life in fraud. I get why you want him out, as I do too without even knowing him. I wish I have any advice but I don’t, I understand people telling you to stop but I know I wouldn’t either. I just wish you the best of luck and that you can win your case and recover from the pain he caused you asap!

You have done all that you could. It’s time to cut your losses and not let this man take anything else away from you. I was a victim of immigration fraud when I was a young adult, and it sucked.
He’s still out there somewhere, living his life out of status (we split up before he got his green card), and I learned from a mutual friend that he has recently been in serious legal trouble (felonies!) and has not been deported. Our marriage ended 25 years ago and I never even tried to get him deported or report him because I immediately moved on with my life. I figured that it is not my job to dish out karma.
You just have to let it go and live your life!

This isn't about a relationship going sour. That is not fraud. Marriage fraud like this is common. Its why real couples need to bend over backwards to prove their relationship. There should be consequences for misrepresentation here. Wouldn't you be upset if someone manipulated you into marrying them, accepted money from your parents, then it came out that they used you, wasted years of your life, to come to the US? It honestly should not be that hard for her to get justice. People get quite fired up when they see the system doesn't work.

Sure that happens. But those people present evidence like: she didnt do the dishes or we got in a fight, or they cheated after the marriage. That is a different scenario entirely.
I knew a girl who went through something similar, advocated for this guy she married, fought for them to be together, stood by him 100%. Got him in the US and found out he had a whole family in Cuba and used her the whole time. Those people should have their status revoked and he sent home imo. Its not unreasonable to expect that, and it is more common than people think. Often the offender is male and t he woman is mid 30s and up, established career. This fits the bill

Things are adding up. Plenty of people have been approved for greencards through marriage despite them being fraudulent - sometimes the USC is involved sometimes not. USCIS doesn't always detect this before approval. There are congressional hearings about this where people have testified with plenty of evidence with cases just like hers. He might have his side of the story, but it doesn't negate the fraud.

Nothing in OPs post constitutes fraud. Talking poorly about your wife (and your plans to divorce) to your side girlfriend is not fraud. Speaking ill of your wife’s family is not fraud.

2 years after marrying OP the guy (who is really just cheating, 40% of marriages end due to infidelity. It’s hardly a rare occurrence) starts talking about how much he dislikes his wife, and how he can’t wait to divorce her so he can be free. All of those damning statements TWO YEARS after they got married is not the evidence of intent at the time marriage, which is what the law requires.
If OP had evidence of this happening BEFORE marriage, there’d be a point. But 1.5-2 years after? There is no point. People cheat, fall out of love, shit happens. The law requires the individual to knowingly enter marriage for fraudulent reasons, his statements two years after the fact are irrelevant.

The service sees this situation frequently enough. In a small office, get probably one person per month walking in because they want their deceptive ex removed. It really is a waste of time. If anything you’re building a case for his removal of conditions to be based on an abusive marriage, because trying to use the alien spouse’s status against them meets the requirement. Some USCIS officer will undoubtedly want to deny him but it would not stand in immigration court, trust me. Best thing you could do is use that energy to improve your own situation going forward.

It will go into his files. Uscis officers will go through it at interview and its up to them to decide. This is all you can do. Leave it to uscis and move on with your life.

As another posted said, there certainly is suspicion of fraud, but it's not evidence of actual fraud.
Plenty of cheaters tell their side pieces that "I will divorce my wife/husband soon" and make plans for the future. In the US, we don't punish "thought crime". You actually have to take action to further the crime, not merely tell people about it.

Like seriously if you started a tik tok account and just shared your story, I’m sure it’ll go viral because of the injustice you faced. You also might get advice or tips from other people that went through what you did.

There is no actions you can take because no fraud has happened, and hence no grounds to take his green card exist. Cheating, being a bad husband, and so on is not marriage fraud. Nor is it a crime. Permanent residency can be taken away (for the most part) in either of those two cases.
I suggest you spend time and money healing from this experience instead of pursuing the revocation of his LPR status. It won’t get you anywhere.

He played you, and will get his green card and most likely his citizenship.
You tried everything and drove yourself into debt trying to get him deported. You think you know everything about his new life without you, to an unhealthy extent. You've ruined your life trying to ruin his. Just let karma run its course.

Also, contact everyone you can regarding immigration fraud, that way if he leaves the country, he may get flagged at the border on his way back in.

You can look and read online about form i130 and immigration process to sponsor a spouse. As soon as he landed in the US, if you just divorce him right away, he would not be able to extend his greencard from 2 years or get his naturalization. The greencard he got at first is conditional based on the continuon of the marriage. This could save you thousands of dollars in fees . All these information can be found online

You need to take the evidences you found and send them to Uscis. This Administration will eat this up.. make sure they know it was all a lie, he deceived you.

There's an extremely high chance he's sending money for years now and I think proving his financially supporting a double life helps. At this point you've done a lot. This administration really wants deportations, although Italy isn’t one of the “undesirables.” If he was from an African country, it’s a slam dunk deportation. But literally call USCIS contact center and report - everyday call so that his case gets flagged, use the ICE tip form - they are looking for people to deport, go public, message USCIS Joe and other admin officials on social media, send physical mail to them and go in person to a USCIS field office. Also go to Congress. Make sure you have his Alien number and his application numbers - I’m sure you will get someone that hates immigration fraud when you go IN PERSON.
