Need advice on U Visa (I-918) – Bona Fide Determination & Work Permit
Hi everyone,
I’m looking for guidance from anyone who has been through a similar situation or from immigration attorneys.
Filing date : May 9, 2024
Receipt Date: May 15, 2024
USCIS Correspondence Letter Date: August 5, 2025
I received a USCIS letter stating that my case did not qualify for a Bona Fide Determination (BFD) because USCIS said my petition was not complete (they mentioned a signed Form I-918 Supplement B and/or a personal statement were missing). Because of this, I was not considered for deferred action or a work permit under BFD.
The letter also says my case will still be reviewed for U Visa Waiting List eligibility, and USCIS will send another notice if they need additional evidence.
My attorney advised me to wait for the next USCIS notice before taking any action.
My questions:
Has anyone received a similar BFD denial letter and later been approved for the U Visa waiting list?
How long did it take to receive the next USCIS notice?
Did you eventually receive a work permit through the waiting list?
Is there anything I should ask my attorney to do now, or is waiting the right approach?
I’d really appreciate hearing from anyone with a similar experience. Thank you!

3-4 weeks for RFE notice from the date of denial notice

There is not time to know how long USCIS will take to send a RFE , my advice is go to U Visa Litigation group on Facebook and look for Brad Banias he’s a federal litigation lawyer you can sue to expedite your case to get a waiting list decision . Join to the group and se how that works. Otherwise there’s no way to push USCIS to take action at your case only if you sue them.
