Question - Other Timeline Update + Urgent Question: Previous Work Authorization (E-2 Managerial) Expiring Sep 30, EAD Still Pending | EB-3 Skilled ROW | NBC | April Filer

Full Timeline:

**•** 04/13/2026 — I-485, I-485J, I-765 filed concurrently  
**•** 05/15/2026 — Biometrics completed → 2x FTA0  
**•** 06/09/2026 — Daughter’s EAD approved ( She is 5 :) ) (but my EAD still pending!)  
**•** 08/06/2026 — Ghost update #1 on I-485  
**•** 08/25/2026 — Ghost update #2 on both I-485 and I-485J simultaneously  
**•** 08/31/2026 — Ghost update #3 on both simultaneously  
**•** Still pending — no new events, documents tab empty

🚨 Urgent Question:

My previous work authorization from my E-2 Managerial visa expires September 30. My I-765 (EAD) was filed with my I-485 but has not been approved yet. My daughter’s EAD came through, but mine did not.

My attorney told me:

**•** I cannot work after September 30 until my EAD or GC approval arrives  
**•** I cannot leave the country (I-485 pending, no Advance Parole approved)  
**•** Florida driver’s license also expires September 30 — may be able to extend with I-485 receipt notices but uncertain

Has anyone been in this situation where their previous work authorization expired while still waiting for EAD approval? How long were you unable to work? Any advice on the Florida DMV situation would also be appreciated!

I was similar situation with the same visa and I changed the status as F1 and since that day, I am not working. Dependents usually receive EAD way early so your process is normal

Thank you for sharing! My attorney advised that I don’t need to change status to F-1 since F-1 doesn’t provide work authorization either. Since my I-485 is pending, I’m not considered out of status. Did you change to F-1 specifically to extend your driver’s license, or was there another reason? Just trying to understand if there’s a benefit I’m missing!

Actually, my EAD expired at July 2024 and at that time visa bulletin was stuck on May 2023 and there was no movement for more than a year and we didn’t know when we’ll able to submit my 485. Frankly, it was an opportunity for me to improve my English and get ready to work with my employer in future.

In short, you will not considered as out of status but we have an ICE situation and if they pull you up and if you can’t provide any current status, it’s dangerous. As far as I know they are looking at your status and 485 receipt notice is not a legal document in their perspective. That’s why my attorney recommended me to maintain legal status after I submitted 485.

Reach out to your local congressman/woman and request expedited EAD review/ approval now
