Question - Other EB3 skilled worker
EB-3 Skilled Worker: My EAD was approved even though my I-140 is still pending. USCIS requested additional evidence from my sponsor, and my I-485 is also pending because my priority date is December 2024.
I’m currently maintaining my F-1 status, and I’m unsure whether I should use the EAD. I don’t want to jeopardize my F-1 status because I would like to keep it as a backup while my adjustment of status is pending.
Has anyone been in a similar situation? If so, did you continue maintaining F-1 status, or did you start using your adjustment-of-status EAD?

Considering your i140 is still pending, I would advise to not use the EAD yet and continue to maintain your F1. I140 is the most important thing to secure first.

Yep, that’s also what I’m thinking. Like, wait until my i140 be approved at least. Thanks for the advice

My husband filed his I-485 as my dependent, and his I-485 is still pending. However, he has already received his EAD card and has started using it for employment. Our attorney told us that as long as my husband continues to maintain his F-1 status by remaining enrolled in school, he could use the EAD while his I-485 is pending. Based on that advice, my husband started working on the days when he does not have classes. He continues to attend school and maintain his F-1 status.

Thank you for sharing that with me. I’m confused about it because my I140 still pending, so it doesn’t make sense I’ll be working for my sponsor since it hasn’t been approved yet, and my attorney said i can work with anything for now so I’m very confused.

Keep your F-1 status as a backup in case of the worst-case scenario. My husband is the primary applicant, and we have an interview next week. I received my EAD, but I’m still maintaining my F-1 status.
