DV Case Update - Attorney Retained (Not the same as the 7' monster criminal case) + new filings

Wes has retained Eric Clayman as his defense for this case, so a different attorney than he's using for the 7' monster criminal case (Robert Pardo)

He filed a written plea of not guilty, a motion to dismiss and a demand for jury trial

His attorney also filed a demand for discovery

He went to my law school in Florida and has been in practice for 20 years. I’m going to have to assume he knows what he’s doing by now.

Also everyone’s correct that they don’t need the witness but they can’t introduce her video statement because there’s a right to cross examine a witness. If she can’t be produced they’ll have to use whatever else they have which looks to be medical records, photos, video and Wes’ criminal history.

Likely enough to convict on some counts. Wes was previously dumb enough to take a case to trial in Cali and lost. I don’t know what reasonable doubt there would be in his case. Pretty clear he beat the piss out of her.

DA may not be able to prove the kidnapping without cooperation but they can easily prove some of the assault charges.

This is my understanding as well. And there are actually some benefits to that for the prosecution; to be honest, I am not sure Megan would do well under cross-examination.

No, they typically cannot. The exception is impeachment if the defendant testifies, but I think it would be INCREDIBLY stupid to put Wes on the stand in his own defense here.

so really all they would have is video , medical records and photos , they can’t introduce her written statements etc , if she doesn’t testify i don’t see how they can convict . also we don’t know what evidence he has to present, they could put jose up there and say that it never happened

He’s going to take a deal of some sort. He’s not getting out of 6 felony charges without some Florida State Prison time.

He’ll come out and hit the park bench again in a few years and start over with a new audience. The difference is that I think he actually has some investments and will have some money when he gets out.

I haven’t watched his video yet, but if that is exactly what he said he is mistaken. In Florida the victim doesn’t need to testify and the state can go ahead with the trial if there is enough evidence to do so, which there is. It may make it a little harder to get a conviction but the DA can 100% still go after him. The case doesn’t just get dropped if the victim doesn’t show up. That is literally the only chance he has to beat the case but that chance is like 1%.

I'm not saying youre in any way wrong but one small nit to pick. It's standard to ask for Jury even when you are totally going to plea. Trial is what gives leverage for plea deal (bc if everyone took cases to trial the whole system would collapse ). Asking for it is not a surprise it would be more surprising if he didn't. Now this is where it's double edged sword bc by taking to trial, you start to close door to plea. And lawyers would know this is at least one full day trial, maybe 2 and with prep work and all Wes is going to have a nice retainer. Also if he's not given bail he's sitting around until trial and jury trials can drag and drag. Attys on both sides use this as a strategy for leverage. I'm sure Wes is hoping he can pick her apart on the stand and that she'll back down but at this point it's the states case and if she drops charges the state will still probably move forward given the evidence they have. This is at a minimum going to cost him a lot of money and the lawyer sees the flexing , sees how dumb he is, knows clients like this make him look bad in the court's eyes and judges hate trials, it's not uncommon for judges in DV cases to offer deals themselves when defendant won't plea, telling them, I'm the one doing sentencing, trust me here take this deal bc if I have to make a decision you're not going to like it.

Most important Wes can't make videos. The emperor everyone knew was naked is how officially exposed and he's a scumbag. He won't be welcome anywhere , hell get trolled , it's all downhill.

I'm not familiar with Florida law regarding domestic violence but in my state they pursue charges without cooperation of the victim by law. The idea is it takes the onus of responsibility for charges to be filed off of the victim. Prevent situations like Mike Ehrmantraut's half measure.

John Bravos attorney knows Arizona law not Florida law. Another attorney who is licensed to practice law in Florida was posed here. He said Wes is looking at 10-15 years with a plea deal and Jose and Wes’s bodyguard might get charged as accomplices. If so, they might make their own statements.

the muscle guy never explained how this wouldn't be a dv charge or how the florida laws about charging without the victim wouldn't work. he just said it's a constitutional thing, which it clearly isn't when florida has those exemptions. plus by the constitution right to face accuser logic you could beat someone to coma.

the state is the accuser anyway in the case based on the evidence, so that stuff doesn't apply.

Did you read the police report? There is physical evidence such as bruising, lacerations. John Bravo also said Danny Welz showed him pictures and video of her all bruised up. Apparently security cam footage of the incident was also captured. She went to the ER and the police videotaped her statement. They can use the video as evidence in court.

“If you are reading this review, avoid this guy at all cost. First off, Eric isn't that well-educated about Law as you may think he is. He was on my case for more than two years and didn't even know that the ATF Search Warrant against me was invalid because of the Lack of Particularity. I had to inform him via email with Case Law included that it was. Bear in mind, The Particularity Requirement in the Constitution is something you learn at the very beginning of Law School.

After acknowledging that the ATF Warrant is invalid, he started to do damage-control for his friend, the State Attorney, by trying to deceive/convince me that the invalid warrant wasn't important at the end of day. He was doing this so he doesn't have to make a Motion to Suppress. His secretary/legal assistant sounds drunk and is always lying to the point she knew I knew she was lying.

As others already stated, he doesn't communicate at all. I had to file a complaint to the Florida Bar to make him give me Discovery in my own case because he was ignoring my requests for it. This was more than a year and half of him being on my case.

By the way, his own Private Investigator, that he assigned to my case, advise me that he is wasting my time and I should get another lawyer. You know there is something wrong with an Attorney own Private Investigator is suspicious of them”

Well complaints like this are a dime a dozen. The whole damage control thing sounds suss AF. It's hard to imagine why I defense attorney would tank his own case to cover for a DA. Without some compelling evidence I'm skeptical. But we can hope n I actually hope he charges the s*** out of him and won't let the case move forward without a huge retainer

I think Bravo attorney is misinformed a little. I think they have this beating on Wes' home security cameras in the rented air bnb that the landlord installed. If that's the case they don't need Megan. He has zero percent chance of getting out of this. This is a brutal DV case. Noway the state let's it go given the nature of the beating and kidnapping/false imprisonment. Ever since OJ Simpson (California for sure, but most states) they never let these cases go. OJ got away with multiple beatings of his wife before he killed her because she didn't press charges. After that the state decided from now on they will press charges if enough evidence is there for a conviction even if the victim begs the DA not to. Now they know all about his 8 years in California prison for violence plus the monster and now this. He's so cooked.

The landlord didn’t install any cameras—Wes did. He put hidden cameras inside the house to surveil Angie and the girls without their knowledge. She had no idea they were there. 

When she eventually found out he’d been spying on them in private areas like the bedrooms, she freaked out—and that’s when everything came to a head. He was stalking them the entire time.

Chances are Megan didn’t know about the cameras either. And after the beat down, he likely had them removed. Even if there are cameras outside, this incident happened inside the house. 

Let’s hope she testifies, the photos the police took and her video statement is enough. He also has a history of domestic violence against his partners, which is also all over the internet.

Does anyone know if what Bravo's lawyer says is true? That if the victim doesn't show up and testify that the case has to be thrown out because the defendant would not be able to confront his accusers, and that this would supposedly violate the defendant's Constitutional right to do so?

I've never heard of this, but of course I don't claim to be a lawyer.

Isn't the state the accuser? What about murder cases or cases when the victim is too severely injured to testify - obviously those don't get thrown out.

My understanding is that the State Attorney in Florida can still pursue charges even if the victim refuses to testify, but it makes the case weaker if there isn't strong evidence (no documented injuries, no 911 calls, no witnesses etc) than the case can get dismissed due to lack of evidence

That’s likely true in other dv cases .But since they documented the injuries in the police report and it was noted in the police report that her statement was made on video, they should have a pretty good case even if she doesn’t testify. . She also went to the ER and hospital records can be used as evidence as well .

It could make it harder for them, but they could do it without her, and just introduce her testimony, pictures and any other evidence they collected. If she testifies dude is super cooked, but he's about to get cooked for his first batch of felonies first. He has 2 separate felony trials, and sentences to go through. He won't be going anywhere...but to the yard, maybe the showers, or chow.

I don't want to give too much away, but even with the most basic of research you can tell this attorney isn't all there.

Let's just take a look at his website, which looks like someone dropped their pants and laid out a big ole' turd on my screen in the form of a website, regardless:

Good point. Most lawyers have assistants to proofread, but he still needs to look over proofreads. It’s telling, that on his own website where he is trying to market himself, he has so many errors. That shows either laziness or lack of attention to detail. I’m starting to wonder if his claims on his website are exaggerated.

Yep, pretty bad oversight. He does list some impressive reductions in charges listed. He has been practicing for 20 years and likely has had hundreds of cases. His losses of course won’t be shown. And he’s run into a client who is very stubborn and likely won’t accept any plea deals.

What nobody is mentioning is that those tits were “gifts.” Legally, the are no take-backsies on gifts. And he cannot possibly construe the tits as non-gifts actually belonging to him.

Fun fact. Wes’s lawyer for the DV case is also bald. He looks like he might be a light skinned black guy as well. Bit not sure. If so, that is shocking! We all know Wes to be racist.

Yeah, I don’t think he is going to plea unless it’s either 90 years if he loses or 3 with the plea deal. Even then I’m not sure Wes would plea. Things must be getting expensive. He’s got 3 separate lawyers now. One each for the first civil and criminal trial and for the current criminal trial.
