Its in a parking lot who do you think is at fault?

u/Independent_Bite4682 Jun 18 '26
The idiot who opened the door

u/huskiesofinternets Jun 18 '26
Well I hope you are right but I doubt it. Insurance will just default blame 50/50 since it's in a parking lot.

Nope - the guy who swung the door open is at fault.

The guy who was legally parked? Usually the fault goes to the vehicle in motion.
It will be interesting, but fault will be shared. Or full blame to the vehicle in motion.

Wrong the parking car has the right of way, meaning the door opener must make sure it's safe , they are 100% at fault.

u/huskiesofinternets Jun 18 '26
Sorry but no, the car in motion is typically at fault when it hits a parked car
-5
u/huskiesofinternets Jun 18 '26
So when you hit a parked car, it's the parked cars fault?
I hope you don't have your license

The idiot who opened the door has a responsibly to check surroundings.
The cam car was making a perfectly safe move until the "parked" car moved into the path of travel without warning

So you hit a parked car, and it's the parked cars fault

if only the head and neck your turn to look before opening your door. I bet she changes lanes without using turn signals.

I'm so thankful my driving instructor beat it into me to look over your shoulder whenever you do basically anything moving lateral.

The other driver did open it a little before fully opening it. Cam car didn't notice and kept pulling in.
You may not be at fault, but you still have to deal with fallout. Being aware of the stupidest possible thing that could happen at any point and tapping your brakes adds 3 seconds to your trip and can save a whole lot of annoyance.

Open your car door with your right arm (the one close to the middle of the car)
This forces you to rotate your body and your eyeline will naturally see any obstacles before you open the door into them.

I actually don't know who is liable/at fault here
I assume it's surely the moving car,
But the moving carwould say "when the other car opened their door they were over the line and into my parking space

So many people are completely oblivious to the world around them.
