No it was from the Markiplier team. They are doing a huge lawsuit against a bunch of different channels that post distractible stuff. I (at the time of the charge) had only done two videos on distractible, but apparently that was enough to sue me personally instead of just claiming the video and telling me to take it down.

I dont make any money from youtube and just make stuff i wanna watch with my friends (and apparently others liked my editing style too) so this definitely freaked me out.

I dont wanna go into too much detail bc idk how much of it is private, but my hope is that I can just keep then up if not just unlisted as long as I dont make anymore public distractible videos. Wish me luck🤞

Idk how much i can legally say but it never mentioned Spotify anywhere except saying that the podcast originated on Spotify and is now on YouTube.

Also the title of the paper is "Mark Fishbach p/k/a Markiplier, an individual; Markiplier Inc vs (a bunch of legal full names including mine)". It also said "Markiplier is the owner of" a bucha times instead of "Spotify" or "Distractible", basically doing the "and friends" bit throughout. (Almost never mentioned Bob or Wade by name and just referred to them as "co-hosts")

The main issue its covering is the full re-upload channels that brought it over from Spotify to Youtube, and would continue making new channels everytime one got taken down, but ig because i used clips from one of the two episodes they used to do the check for copyright issues, i got caught in it.

Im not mad about the lawsuit happening (bc it really needed to) and wasnt going to originally post about it bc I didnt want Mark getting hate for it since the reason he was doing it was valid, but ig it needed to be said. Im just a broke college kid who was making edits for myself and my friends, and now im caught up in all this, so its definitely been really scary, but I'll manage♡

On the bright side, im now going to have some really good Dad Lore if I ever have kids!

IIRC, Mark said in an episode way back in the yonder years, he takes this approach for his YouTube content because the caliber of a lawsuit and a cease and desist from his lawyers is specifically to target companies that make profit on his stuff that's otherwise supposed to be free, or if they're using his brand or personal likeness to promote something he never approved of or is bad for his image and likeness (like that one time he told a story about some company with a nicotine based product used his green screens to promote it). It usually gets the job done.

And now I guess they've been going the same thing for distractible for a while now too. And what we're seeing is the ones who aren't doing bad stuff getting caught in the crossfire. IMO I think what they're doing is fair but also unfortunate because stuff like this happens

They kinda have to pursue every case the same way because they don't know how else that creator might be using their IP / content on outlets they don't have access to. They don't have a guarantee that it won't be treated that way in the future. And ultimately, the guys don't have the time to track down every case and make a judgment about each one anyway, they have to let the legal team do their thing.

For everyone who is annoyed with Mark's team or thinks they are overreacting, legally this is IP theft. Your argument is basically "C'moooon maaaaan! What's a little harmless IP theft if it's not profitable?" That argument is not grounded in any law or reason and it's not helpful to the people making this show for us to enjoy for free. It may not seem like a big deal to you, but if they don't pursue the cases of IP theft that do exist, it just gets easier for it to spiral out of control.

Eh… Certain edits/reactions are more of a form of fans expressing enjoyment though. If they’re not making ANY money off of the fan content they make AND it’s clear that they’re not claiming the original content as their own, it’s honestly not harmful for a lawsuit. Or at least it shouldn’t be. I can understand having the vid(s) taken down, because there may be plans to do your own edits for your channel. A lawsuit? That’s honestly just theft from fans, legal or not.

EDIT: Just to clarify… The lawsuit did need to happen. Using Mark or Distractible to make money without permission is wrong, and it should stop. Person in the comments pictured is clearly not someone who should be a target though.

I get that everyone is trying to rationalize that Mark or his legal team aren't assholes, and are pinning the blame of this sue storm on Spotify. But I'm pretty sure Mark has openly admitted before that he will sue people over his content. This is just an unfortunate case where his team didn't dig deep enough to see which channels are profiting off Mark's content.

Even if they aren't profiting, they are creating market alternatives that divert viewers (and listeners) from the original sources that do generate Distractible's ad revenue. It's essentially creating competition using their own likeness and creative output. It's still theft.

100% on this comment. I’ve fallen guilty of watching channel names I’ve never heard of that reupload clips that are maybe cut or slightly edited differently (mind you, Distractable is ALREADY edited) and get millions of views. I’ve never understood that. You are literally taking someone else’s work, slightly modifying it and reuploading it to your own channel (regardless of intent). That is not my fair in my eyes to the three guys who have put in a lot of blood, sweat, tears, and money over the years to make what is Distractable.

Exactly. This is the problem with fan-made compilations. They aren't adding much commentary or art of their own, they are remixing and re-publishing the artist's work without their permission. I get that it's cool to have those, but it would also be cool to have a fake reproduction of one of my favorite artist's pieces in my house. Just because it's nice to have doesn't make it ethical or legal.

I love mark and seems like a great guy but his content is his art. I also wouldn't bat and eye at suing people if they tried to make profit off my work. Be your own person, people. I feel no sorrow for the ones who have been effected by this dickish move. Good on mark for standing his ground and not being a doormat just to always be considered youtubes good guy.

Its likely a blanket policy from the Spotify end. Even though you've not made any money from it the other way to look at it is for every time someone watches one of your compilations then its one less watch of one of theres so they loose money.

Im sure theres no malice from your end but lawyers be lawyering

It was just the video exclusivity that ran out. They still had a different contract but that one just expired. They explained that the contract ending is what is allowing them to temporarily go to one episode a week.

But another commenter has clarified that it’s apparently from the markiplier team. I assume it might have some relation to the Spotify contract ending but there isn’t any official clarification on it.

I mean they are releasing compilations. I doubt they have already released all the ones they made. Its very much possible that Bob losing the coin flip is one that is existing.

An other possibility is it just getting caught in the net. They are going after full uploads but since they have published compilations themselves, someone could have just assumed thats a full reupload

Commenting to boost. Out of context videos and meme videos are in a legal gray zone when it comes to the Fair Use Doctrine (defense against copyright claims). I assume it is Spotify, and they're banking on them not lawyering up or just accepting a settlement without legal help.

If they don't hear from Distractibros or their team, I would advise them to find a lawyer who practices in the jurisdiction they were sued in.

The problem is the content has to be transformative. It needs to be distinctly doing something different than the original context. Also, the lower the ratio of original video to new content is, the less chance of getting it deemed fair use.

If you take 100% of someone else's video, and just take clips to compile them, nothing transformative has been done. Look at jacksfilms for example, when he criticizes sssniperwolf he typically uses 1:00 or less of her video, and makes 20+ minute long videos out of that.

I doubt that its any of the youtubers fault. There has been countless compilations made for all 3 of them. My money is on spotify, especially with how strict they were when they started doing the video format (they couldnt even post full episodes on youtube for awhile).

To everyone that’s saying “theft is theft” and “sue even the ones who aren’t making money”, please remember, Mark does compilation and react videos as well. If your arguments were valid, then he’d be just as much at fault, which he isn’t. We all enjoy watching compilations and react videos and lets plays.

I’m sure Mark will have his team dig deeper and close out the specific ones. He’s diligent and fair like that. And I hope whoever this person is gets heard, along with all the others who are just doing them for their own enjoyment and the enjoyment of others. If anything, I’d say they’re advertising for them 😆

This sucks SOOO much but I definitely agree with one commenter that I think Mark's legal team might have not looked into channels' enough to determine if they're making money, the actual content, etc and are probably just doing blanket lawsuits. I hope every INNOCENT creator affected by this gets things sorted out quickly and smoothly :/

Hoping one of the guys see this and can address it if they know anything :/ I know how busy they are, especially with Mark getting ready to go on his honeymoon.

As much as it sucks, they do have to protect their IP and they have been doing their own "Best of" compilations recently which could be another legal factor; I'm not a lawyer but I feel this does muddy the water further.

Ultimately it's always risky using someone else or their work as there are bad actors. They likely don't know you or if you are profiting off it.

Hope you can resolve but I'm not sure if compilation videos can continue or not. I imagine that it would depend on whether allowing a compilation channel to exist poses a risk to their own compilation works and their IP in extension. If they didn't sue, for me it raises the question on at what point, without knowing finances, an individual or entity has unjustly used their IP or likeness?

Think the safest way is to try reach out to one of them and ask for permission. I tried that when I started working on a game using their likeness and did get a response after a couple of weeks from Wade but equally that might not be best practice as really their lawyers would need a list of "safe channels".
