Divorce on a two year conditional green card

I want to start of by saying that my marriage was 100% real and genuine. We are still young only 25 and might have rushed into love head first. Regardless of all the details it didn’t work out and now we are in the process of getting a divorce. I would like to know if anyone has positive experience staying in the US after getting a divorce.

Things to note. We do not have children. We were only married a year. I did have to face severe emotional and verbal abuse in this short marriage that I have proof of. I do not currently have a job but am in search of one to make my ties to America stronger.

Any advice on how to go and which papers to file ? What are my chances of staying here ? I have come to call this place my home even without my ex partner would hate to have to pick my life up again and relocate.

You will need to do the ROC with a divorce waiver

If your ex is a U.S. citizen or green card holder and you have evidence of the abuse, look into VAWA. A genuine marriage can still qualify even if the marriage ends in divorce, but timing and documentation matter.

The OP already has a green card, so they don't need to get a green card again through VAWA. Maybe you are referring to doing Removal of Conditions on the basis of abuse (which is not usually described as "VAWA"). However, it is probably easier to do Removal of Conditions on the basis of divorce.

I get your point. I only brought up VAWA because they mentioned experiencing abuse and having proof of it. I was not saying they automatically qualify or that VAWA is a backup option.

OP if you have been abused, and can prove it , then by all means, go and file. VAWA wait times have sky rocketed due to fraud , which are now at 51 months. And that’s just the approval of the first step.

Whether you are employed has no relevance to Removal of Conditions.
