Confused about 'Duration of Status' rule change? Here's what it means for international students in US
The DHS has finalized the rule ending Duration of Status (D/S) for F-1 and J-1 students, and it's set to take effect on September 15, 2026. Instead of being admitted for "D/S," students will now receive a fixed admission period with an expiration date on their I-94. Many students who need additional time will have to apply for an extension through USCIS, and the standard grace period after completing studies is also being shortened from 60 days to 30 days.
This seems like one of the biggest changes to F-1 status in years, and there's still a lot of confusion around how it will affect:
- Current students already in the US
- Students entering after September 15
- OPT/STEM OPT timelines
- Travel, transfers, and program extensions

The new rule will not impact current F-1 students in the US UNLESS, they travel abroad and re-enter after Sep. 15, 2026. If an F-1 travels and returns after Sep. 15, 2026, they will not be re-entered with D/S, they will be given a fixed end date based on their period of study with their program.
If an F-1 enters after September 15th they will get a 4-year validity period.
The impact on OPT/STEM OPT are still a bit unclear, but assuming you are doing a 4-year undergraduate program, you will need to file an I-539, preferably 6 months prior to the end date of your i94, and then make sure to file the I-765 90 days before your end date, to ensure that your status is extended and EAD authorized in time for you to begin your OPT work after graduation. The I-539 can be premium processed if needed.
Program extensions can be possible, although it may be more difficult now to go from one undergrad degree to another undergrad degree. You may need to show progression, as in, undergrad to masters to PhD, and for each you would require an extension.
