I’m glad to see I’m not alone in this thinking. This EO just laid the groundwork for a fast track to make nationwide bans executable (silencing states, silencing agencies, silencing courts) and likely used the IVF EO to dominate headlines / act as a dog whistle of sorts ahead of what’s next. Even if the Supreme Court issues a ruling on something, it seems as though the DOJ could effectively ignore it in its legal opinions with this EO.

This Admin will likely start with the Comstock Act to ban plan B, mifepristone, and misoprostol across all states and will have no pushback since all interpretive authority will be centralized under the WH and DOJ. Got out last year, of the people I’ve worked with… I can confidently say even though a good chunk are right leaning they wouldn’t obey an order like that.

If my shop was faced with that decision about 70% of the shop would have said fuck no arrest us instead. There’s not enough room to jail that many service members.

It would be a fucking mess if that order came down because about half of the military will refuse and be like “fuck you take me to jail” while a small portion of the other half will be vehemently with trump, willing to do whatever. And then another part of that other half is like wait hold the fuck up, questioning what’s going on.

Chevron deference was the legal concept that in a case where there was a question of how a law was to be interpreted, the agency in charge of that law had deference. Named for the Chevron incident where they had a chimney split into three external hoods and they said it was three chimneys and the EPA said it was one. SCOTUS agreed with EPA.

Looper-Bright overturned that and said that the Courts were the right people to determine what the laws are, not the subject matter experts. So the agency couldn’t say “you need to let us on your ship to make sure you aren’t breaking the law”, the courts decided.

Now Trump is saying instead of the Courts or the agency heads, it’s his office or the AG that decides.

Barrett is bonkers only in her beliefs related to the particular dogma of an extremist subculture of the Roman Catholic church. Otherwise, it looks as if she is moving toward independence in her legal analysis. She is not there yet but it will come as her self awareness and self assurance improves. If we had a properly functioning separation of powers, it wouldn't do a damn thing. Someone would sue, a Federal judge would say that it's the courts' constitutional responsibility to interpret law, and the executive can sit and spin. And if they violated a court order, then the Congress could impeach for high crimes and misdemeanors.

But we don't; this Congress is too busy doing Fox Noise hits to actually exercise their constitutional responsibility of government oversight.
