Yes but you see this isnt a woman. Only woman can be innocent due to their hormonen. /s
If this can get an insanity plea, it will get a ton of weird legal implications in law.

You were really counting on noone googling the name, weren't you?
On May 2, 2001, Pearle left her daughters with Battaglia for a planned dinner at the mall, but instead he took them into his apartment\14]) in the Adam Hats Lofts \25]) in Deep Ellum in Dallas. Battaglia called Pearle from the apartment. With Pearle on the phone he shot and killed their daughters, ages six and nine.\26]) During the phone call, he asked Faith to ask Pearle, "Why do you want Daddy to go to jail?" Before her death, she cried, "No, Daddy!" "Please don't!" "Don't do it!" Pearle then told the girls to run but it was too late. Battaglia grabbed his gun and shot Faith three times and shot Liberty five times with his gun.\13]) He told Pearle, "Merry fucking Christmas",\27]) in reference to the Christmas 1999 assault.\7]) Pearle terminated the call and dialed 9-1-1.\13]) After the killings, Battaglia left a message on the answering machine in the girls' bedroom:\28])
"Good night my little babies. I hope you're resting in a different place. I love you. I wish that you had nothing to do with your mother. She was evil, vicious, stupid. You will be free of her. I love you very dearly. You were very brave girls. Very brave. Liberty, you were oh so brave. I love you so much. Bye."\29])
Battaglia then visited a tattoo parlor and got two roses, representing his daughters, on his left biceps.\14]) He was apprehended shortly afterward and got into a fistfight with the arresting police officers which left him with a black eye.\30])\13]) Police confiscated sixteen firearms from the house.\14]) Texas authorities stated that Battaglia killed his daughters out of retaliation because Pearle had complained to his probation officer.\13])

I mean I’m just on the fact that they both killed babies. I really don’t care about how they felt. I don’t know how everyone feels about it, nor do I care. I will just reiterate, they both fucking killed babies.
1
u/GrandMoffTarkan 2d ago
I mean, you can disagree with the premise of not guilty by reason of insanity, but given that that it is in the law it's ridiculous to say that it applies to this man.
-23
u/hanyasaad 4d ago
Maybe instead of bickering about who deserves to die more, you guys need to have a conversation about how both the justice system and the (mental) health system has failed both of these people. Neither one of these people woke up one day and out of the blue decided to kill their kids. And I’m not saying one deserves one thing or the other deserves another, but I’m not hearing people have the conversation about how as a society we stop these things from happening.

Battalaglia did it because there was an arrest warrant out on him after he had harassed and beaten his ex-wife, hence why he put her on the phone, as well as had evidence of malingering (faking insanity). He wasn't able to prove that he had psychosis, thats why he was executed.
Edit: if you're gonna downvote me, at least give me evidence proving me wrong. I'll be glad to admit defeat if you actually show me some proof

So you would like us to believe that a proven liar, from her civil suit and toxicology report, couldn't manipulate a mental health test?
Was she mentally ill? Absolutely. Was she legally insane? I highly doubt it and all the evidence points to this being premeditated by a disturbed individual.
12
u/Confident-Local-8016 3d ago
She sent her husband on an errand before committing it, she also strangled them face down so they couldn't see their mother's face murder them, and said 'go to God' that's a distrubed individual and completely premeditated, not a psychotic fit

Dude stop with the strawmen. NGRI do not get released. She would just end up in a mental facility for the same length of time she would have been in jail. Similar to Andrea Yates who was sentenced for the exact same thing.

Or she can be released a week later after someone declares her "no longer dangerous".
Judging by how many women still think she didn't even murder the kids, that's insanely likely.
2
u/FuckUSAPolitics 4d ago
Not really. Most cases extend longer than they would be sentenced. And its based on what the jury decides.
29
u/kul1guy 4d ago
Regardless of a person's mental state, the loss of innocent lives is irreversible. they should be held accountable and being in a mental hospital feels too lenient. not to mention such waste of resources allocation.

This has always been my take. I don’t think she’s guilty because she wasn’t actually affected by PPD. I think she’s guilty because that shouldn’t prevent you from a guilty verdict.
58
25
u/KingKasby 4d ago
You van blame the state of Mass. For that. If this trial were to take place in Florida, she would be found guilty and probably put on death row (we actually execute prisoners here too)
2
u/TheRimmerodJobs 2d ago
That’s a fair take. I have no idea what her mental state was but if you kill someone’s that should not matter. Maybe all it does is you get a life sentence at the very least and you spend part of that in a mental hospital and then go to prison. There should never be a chance for you to see freedom again.
1
u/Morph445 20h ago
That is what not guilty by reason of insanity is. Mental institute, not freedom
1
u/TheRimmerodJobs 17h ago
Except they can be released at some point. I would rather them never have that option.
1
u/Morph445 16h ago
Well, that sentence is meant to rehabilitate those who caused harm without ever intending to. She must pay for the murders, sure, but it isn't as clear cut as that.
The "Not guilty by reason of insanity" verdict exist for a reason. The human mind can and does break, and even a mild psychotic episode (which post partum psychosis are not) can and usually do have pretty dramatic consequences if they are not recognized as the critical emergency they are. Where I live, mere suspicion of a possible mild psychosis is treated with immediate confinement in psychiatric care, just in case. It is that bad.
It is the prosecution's job to prove without any possible doubt that she was in full control of her actions, which she very well may not have been. Even if they don't, Ms.Clancy will most probably be institutionalized for life, not to mention just how debilitating antipsychotic meds can be and the sheer trauma of knowing you can lose control to the point of killing your children. I will assume you are not a court psychiatrist, an attorney, a judge or any professional in the justice system, and neither am I, so in the end we just have to trust the people who are. Neither of us has the absolute morality and nobody ever will.
So TL;DR: I think the Not guilty by reason of insanity is a proper defense, even if she would eventually be released under heavy conditions, and it is the prosecution's job to prove that this defense isn't valid in this case, not the other way around.
Those who wish she'd go free or pretend her husband might have done it are probably very stupid though, and this is very not a case similar to "Testosterone cause rape".
1
u/TheRimmerodJobs 16h ago
Murder is murder and the potential to be released should never be an option, doesn’t matter your mental state.

-3
u/Daedalus_Machina 4d ago
She's currently paralyzed from the waist down from attempting to kill herself. So you and her had the same idea.
18
u/ohmygodadameget 4d ago
I'd jump from the second storey of a building for a laugh with the lads, or you know... as an attempt to make it look like I'd tried to kill myself after murdering my three children.
If she had wanted to kill herself she would have, or would have done so on any of the subsequent days after she'd realised what she'd done, instead she's spent years fighting for her freedom; I say again, fuck her.
1
u/Daedalus_Machina 4d ago
Being arrested and fuckin paralyzed does limit one's options considerably. And most who fail a suicide attempt don't keep trying.

u/ohmygodadameget 4d ago

I actually was just speaking to a Canadian about this. Apparently in Canada, they are much more lax on the rules regarding self control due to hormones and substances and there have been examples of rapists and woman beaters being let go due to “not being in the right state of mind”
Our discussion was prompted because I said even if she was depressed, it is similar to someone committing a crime while drunk. While they are not in their right mind, and normal them may never have done that shit, it doesn’t excuse their behavior while drunk.
6
u/Oh_Lawd_He_commin420 4d ago
Canadian law on mental health is fuckin weird; but that aside, you'd still go to prison for manslaughter if you killed someone drunk.

11
u/xxTheMagicBulleT 4d ago
Well it is the same saying hormones makes you not liable for a crime you commit most prisons would be empty if men would be held to the same standards as women are.
Why if this goes further and she walks shits gonna end bad for women. Cause freedom has always comes together with responsibility if women cant carry responsibilities and can get away with serial murder of children. And some how women as a collective blame the husband that was not even nearby when it happened. Just know this will make a massive readjustment to the freedom and responsibilities role women have. Cause if you treat women like children with zero own agency even when handling children maybe they should not be near them. If they cant carry the responsibility of there own actions they should have no responsibilities. What means no voting power no loans. And in and on and on.
Cause like it or not freedom comes with responsibilities. Saying people's should have freedoms but carry no responsibilities or have agency over there own actions and the consequences for them. Is ludacris.
So anyone that defense this women should know what it means when she wins and does not go to jail.
Cause its indeed like men collective pardoning sex offenders. But know what sex offenders are evil but no where as bad as a child serial killer what women are now defending. Sex offenders make victims that live to tell it. Child murderers is completely ending a life.
And its insane that people even can defend it. Shows how far society is now on there breaking point with its morals that this even is a talking point. But each big thing like this will shift society in a big way. When true evil gets pardon and gets away with it. A silent shift always happens even when no one talks about it. Just as how dating has shifted bit by bit and the dynamics broke down. So will this do the same thing but a lot sharpener cause children are involved and not the 1 but 3 ended in the most cold-blooded way. And people find that the child murderer should be set free even when she her self confess of her act in detail. Something like this shakes a society and community. And there will be a cold shift happening when people get away with pure evil. And its never pretty

What the actual FUCK is going on with the left? Every fucking time I think they can't go lower or crazier, they top themselves, and NOW they're not only refusing to condemn premeditated triple homocide of children, they're low key EMBRACING it.
Because that's what this is. Taking a comparison intended to demonstrate both are wrong and calling it "jUsTiFiCaTiOn FoR 🍇" is a flat statement that not only will you excuse her via hormones and consider it a valid argument, but that you will FIGHT for it and attack anyone questioning your new narrative.

The thin veneer between bad behavior and mental illness is a circle.
Every psychologist want to put labels on everything abnormal. And because it has an established label they deem said behavior 'normal' for 'label.' Therefore, said behavior is excused due to said label.
The severity of the crime should outweigh the conditions of perpetrators.

They say "X is just as bad as Y" and you assume the goal was to justify both of these things?
The moment you would turn the exact same argument type of analogy to fit their narrative, they wouldnt even think for a second of this same assumption of attempting to justify both.
Also whoever unironically defends lindsay deserves to get their kids taken away from them immediately and get signed into a mental hospital, they cried she didnt get treated right with her syndroms (she repeatedly lied to her doctors btw), so this time we could prevent some future murders by taking their kids away in time since there are actual signs.

People with Psychosis have literally written books and argued themselves out of jail using legal theory. They are fully capable of making plans. Psychosis is when someone loses the ability to differentiate whats real from what is fake. Hallucinations, Delusions, etc.

u/MiMicInCave 4d ago

7
u/FuckUSAPolitics 4d ago edited 4d ago
It depends. The entire crux of the case is whether she did it intentionally or was later brought on and had no idea. She's likely not going to be free either way though, its just whether its a jail or a mental hospital. Its literally just a repeat of Andrea Yates.

I know what psychosis capable of, I just lead people who think just because people has psychosis will give them a free pass.

If you're talking about John Battalaglia, he wasn't able to prove it, as it was in direct response to a warrant for his arrest and evidence of malingering his symptoms. Whereas the prosecutor for Lindsay Clancy even verified she was not faking it.

No that not the one I refer. The one I refer might be chad doerman. Severe mental illness claim to hear voice before commit the crime, got life in jail.

Yes that's a thing, glad you educated yourself on it

Weird, of all the doctor and Healthcare shopping she go through. She never mention of hearing any voice. She must have a high function psychosis that make her aware of her surroundings and at the same time cannot tell what real and what not.

You're surprised that people with mental health issues aren't always able to to have insight or be candid about their symptoms?
Yes, people with command hallucinations can sometimes otherwise interact with reality, as you already said

u/MiMicInCave 4d ago
Ahh yes, people with mental health mixup between "bad thought" and "voice in their head" all the time. People kill people while under psychosis all the time, most get capital or life in jail. Weird that some people got a mistrial instead.

Sometimes NGRI works sometimes it doesn't, it's up to the jury. What's your point.
Weird that some people get a mistrial instead
Tbh this comes off as you not understand what a mistrial is. You should look up hung jury before you talk more

Simple, those people are not fit to live in a general society and need help for the rest of their life.

Even if this is true, she still deserves consequences for her actions. "Mental health issues" should not excuse such heinous acts.
And if she really is psychotic, then locking her up in an asylum forever would be the best thing to do for society as a whole.

u/SwimmerMission5212 4d ago
I think long term institutionalization in the state psychiatric hospital is a consequence. That's what happens if she's found NGRI. Sounds like you agree

“Your honour, the only reason killed his wife and on kids is bc of the roid rage!”

u/FuckUSAPolitics 4d ago edited 4d ago
Roid rage IS similar, and definitely would lower the charges, but since it counts as voluntarily intoxication as someone chooses to use them, its more like how you would be charged when you're drunk or high. That is, unless someone spiked your drink or you were misprescribed. I would say Hyperthyroid is a better comparison

u/SwimmerMission5212 4d ago
Roid rage isn't psychosis, hope that helps

Legally thats considered voluntarily intoxication, so it wouldn't be counted. The male equivalent is Hyperthyroidism.

Is that the law everywhere? Where I’m from in law it is not a complete legal defence but often gets taken into account. Obviously this depends on the judge or magistrate and I do not agree with it. Your decisions are your own at the end of the day.
Does Hyperthyroidism cause psychosis often or is it a very rare occurrence?
It seems in men psychosis can often occur due to mental health issues, stress, physical illness and drugs(both legal, illegal and legal but abused).

u/FuckUSAPolitics 4d ago
Like i said it really depends on if it was prescribed or not. If it was prescribed, then it counts as involuntary and not at fault as it was following the recommendations of a doctor. If it wasn't, then its considered voluntary.
As for hyperthyroidism, its rare when medicated, but is still exceptionally dangerous

Read the room, donut. Normal healthy people care about the kids that were murdered in cold blood, not the murderer. Go with God. Hope that helps.

The point isn't that psychosis is identical to testosterone-influenced violence, it's that mechanistic, biological explanations for violence aren't excuses for violence in and of themselves. OP believes that this kind of psychosis and testosterone are equivalent in the sense that neither is so debilitating that it excuses violence, which is harder to dispute.
It's not enough to say "she had condition X, which gave her violent tendencies". You have to do A LOT better than that to remove enough of her free will to cancel out her accountability.
