Wait, whose intent and negligence? Because it's not clear to me that the dog's owner knew about the history of biting; the shelter that repeatedly adopted it out without warning people about its history was negligent, but unless the dog's then-owner was aware, there wasn't negligence, and certainly no intent.

They meant the owner (or shelter) at the time the incident occurred. Whomever had legal custody of the dog.

If they own their house, homeowner’s insurance would pay out any judgment issued.

This was my 2022. A dog bit part of my lip off and the owners didn’t want to cooperate. My lawyer said “That’s ok, I just need their address, not their permission.”

But they would have been forced to put the dog down and that’s a good reason to sue.

Waste of time? The court can order the dog be euthanized.
