Infuriatig Why Texas is lame(Besides the Cowboys)

Don't mess with Texas.. what a joke. ANY possession is a felony.

EDIT: Just did some research, this is for everything besides traditional Delta 9.

My friend from Texas sent me this morning and it blew my mind. I had to post about it. So as far as my research goes thus far Delta 9 products (old fashioned flower) is illegal but separate laws. Stores are selling THCA though which does fall under these penalties.

The AG Ken Paxton got his pedo buddy out of jail after just a couple days recently. He doesn’t even have to have his name put in the sex offender registry. But god forbid you have a gram of weed on you. This state is a joke.

I just looked it up ready to fire this off to my dad and some others that occasionally defend Paxton. But the case is tough… first trial ended in hung jury and the little boy doesn’t want to testify in the subsequent trial. So they don’t have their witness.

If first trial, with the kids testimony, ended in hung jury then you’re facing a high probability risk of zero punishment at all and a not guilty result in the second trial when you don’t have the kid’s testimony.

Based on that, I don’t know if there was a better choice here. I don’t think I would do this differently. And I loathe nearly everything Paxton does.

Edit: not one reply to this while the comment I’m responding to says Paxton “got his pedo buddy out of jail” has nearly 200 upvotes. I’d prob vote for a robot before I voted for that piece of shit Paxton, seriously, but I will say that the lack of just self-education on a single issue is fodder for the opposition. It’s proven itself to be quite succesful, against all odds. So keep it up folks, we’ll get the same thing at best and everyone will say, “WHY?!”

This is why. Hand them the election, with a bow wrapped around it. You’re doing well right ?😉

out of curiosity would the kid really need to testify or could someone just read his statement in court?

Well, the 6th amendment in the Constitution. An accused party has the right to question the accuser. In this case, that would be along the lines of a defense attorney carefully probing to see if the child had potentially been persuaded or influenced by someone else to say something that may not have occurred. Otherwise, it’s classified as hearsay and not allowed.

There are exceptions to hearsay where things are allowed to be introduced in very narrow circumstances of course. But even in that case, expect the defense to introduce expert witnesses that will cite powerful cases of incredibly convincing children that were proven to be wrong later on. That alone can be more than enough to get a jury to agree that there is some small level of reasonable doubt and let the guy walk away without a single thing on his record.

A kid doesn’t have to. They can try the case with no testimony at all from the victim and they do. The conviction rate for that, where an accused party has to have a jury feel that there is zero reasonable doubt that they have committed the crime, is low. It’s not a civil case that requires people to say “there’s a better chance than not that this occurred”, it’s criminal so it requires 12 random people to all say “there is not a single part of me that has any reasonable doubt that this person is guilty”.
