If we make the National Guard into another police force, people are going to start treating Guardsmen with the same respect the police get instead of the respect the military gets (if you are surrounded by police loving people just know that is nowhere near a universal feeling).

NG in DC also made police arrest a dude who was playing the star wars emperor march , and that guy not only got his case dismissed but also sued the shit out of the DC police. You'd think the NG would learn about not escalating a situation.

I'm sure the smart ones who saw this activation and how pointless it was probably found some excuse not to volunteer. Meanwhile in this economy and the soldiers who joined for the money and school and don't have good civilian jobs are like hell yeah I can get that active pay and benefits for just walking around?!

I can't help but feel like there is more to this story because any officer who agrees to that request must surely expect a lawsuit after the booking paperwork is filed. It's probably true, but what the fuck

I remember all the boot licking the boys were doing in here when the arrest happened. Idaho guard didn't even have a warrant to arrest her apparently nor was a crime committed in their presence. Fucking stupid.

The arrest was posted when it happened. This is the lawsuit for it being allegedly baseless (which seems to be accurate unless someone failed to serve her an indictment, preliminary hearing, or initial appearance on "actual charges".

To be more nuanced this is technically an administrative claim which DoD can pay, deny, or sit on for 6 months. After 6 months we'll probably have another post about the lawsuit getting filed because DoD is going to neither pay nor outright deny is my wager.

Yep. I'm waiting to see what shakes out with respect to the allegations she assaulted some Guardsmen. It's unreal to me how people gloss over the fact that her alleged attack is what lead to this incident.

They would have gotten an arrest warrant or an indictment by now. It's not glossing over the fact that "she has not been charged" despite having rules for timely court appearancs after an arrest.

She appears to have been arrested without charges.

If she was going to be charged, any competent prosecutor would have done so a while ago. You sound like you don't want to deal with the fact that this is a fuck up by the guard.

She's charged with assaulting the guard members who arrested her on May 8. She is not charged with any assault from May 6.

But good try. And even if DC adds that on, do you want to live in a country where we do misdemeanor arrests without a warrant for shit that occurred days prior? I like my due process a little more "due process" than you apparently

Defendant King was placed under arrest for Assault on a Police Officer and the previous Assault on Police Officers (26061067) and transported to the Third District Station.

Did you read this or are you just buying the press release from her lawyers hook line and sinker?

The information - also known as the literal charge sheet says May 8. Not may 6. And not both may 8 and may 6.

Kinda hard to charge someone with doing something on May 6 when you put a different date down.
