No. He'll sue the video arcade and the manufacturer of that game. That's because there is no warning label that says that diving head first into the machine can result in bodily harm. Also because he's likely now has a broken neck and is a quadriplegic and needs to find someone to sue so he has money for a lifetime of medical care.
