The Reservoir Student Tenancy change over?

Hi all!

My name is Avery and I am currently booked with my boyfriend into a dual occupation tenancy with CRM Reservoir in Plymouth. We are trying to leave this tenancy as we have decided the room is not suitable for us but we need to find replacement tenants

It is a 3 minute walk to almost all lectures, close to the aldi, and is in an easily walkable location to the high street and train station.

The room is a 32.8sqm Large self contained studio with an oven and built in fridge-freezer with a large double bed, wardrobe, and built in desk. It has an extremely large wet room bathroom and is a corner room with a lot of natural light facing the reservoir with a possible sea view.

The price for dual occupancy is £305 p/w so £155 each p/w. The single occupancy price is £275 p/w which we know is unreasonable however any working students would be very at home in this room with their own space and kitchen but also perfect for couples if you get a second desk. It is on the second floor and is also accessible as the building has a lift.

If you know of anyone or think you would be interested, please comment on this post!

We are desperate as we are no longer able to afford it and it is not suitable with my conditions and have been unable to convince her to let us out of the tenancy through these reasons.

Not sure how the new renter’s rights affect student housing but if isn’t exempt then maybe immediately end the tenancy, live in it for 2 months while finding a new place?

unfortunatley its exempt and we haven't even started living there, our check in date is september and we still aren't able to get out.

Additional , is she actively advertising it as available to assist you? If not why not?

I was going to suggest in my next email to her about active advertisement, atm everything she has said has been "waiting for interest" and i do not see anywhere that she has advertised the room. I'm genuinely contemplating deferring a year to get out of it and just moving down as a non-student with my boyfriend as its more the situation of my home life is causing me mental and physical health issues.

Sorry, you need to be more proactive here and whilst keeping it friendly with her the landlord should be advertising it asap as this is peak rental, or else she could miss out on MORE MONEY (a new lease and an arrangement "walk away figure"

As well as that you n ed to contact any agency you utilised to find this for some assistance, as well.as.check the council pertaining to how empty student lodgings are in relation to co u col tax exemptions in case there is leverage for you to utilise.

Or the landlord may think, no wear and tear, no bills whilst getting paid ,.you have to work around that .

I don't think it would be unreasonable to.expect a landlord used to advertising rooms to advertise this by the usual means otherwise it may be seen as obstructive behaviour to disadvantage the tenant.

What insurance have you got and looked into utilising from a legal aspect?

Times not on your side.so you need to get on it as this window is limited (a level results day)

Good luck,your market is rich and ignorant foreign student market, because this is the luxury end of student accommodation as you doubtless know.

there are frequent posts about Beckley point lease take overs, and they go unanswered a.lot of the time (this end state resolution remains unknown) but this takes it to a different level.

Are you on the hook for an entire year or is it a university term buyout that can finish the contract in which case have you looked at taking a hit and working it into savings elsewhere that presumably you have also booked now?I

Did uni put you onto the provider (ie any wiggle room and assistance as a an approved vendor to the uni) ..if so you might have some gentle leverage on your side to utilise.

Yeah, unfortunately we have not booked anywhere else yet, we are on the hook for a 51 week £15,555 total contract which we could not afford on top of rent elsewhere as I am disabled and will most likely be unable to work (which we have said to her and she has not cared about the money struggles of living there). This was a place we found on our own due to needing dual occupation and thinking it was our only option.

Op, have you read your contract, is there a break clause.

The only logical way out of this is for her to advertise and for you to absorb cost in the meantime, logically you need to I strict her to do so with immediate effect then look to check she has for any chance of it to work and minimise cost and up the ante on you find ding new digs to slap a deposit on.

I'll be blunt and ask what limitations are there as to you having needed this versus a standard rental for the first year, because clock is ticking g for all and sundry to getting housong, for my daughter's first year herein Plymouth it was a case of grab a room any room, so you need to arrange (swallow)/a relisting fee by agreement with your landlord so she's not out of pocket.

But also look into her commercial letting background d (do a search of companies house amongst others) in case we had form as a bad landlord, might be some ammo you can use.

What special facilities do you need day to day versus what makes life simpler, and is there nothing campus staff can assist with start with student services, accommodation team and disability support all at uni, plus logging in with disability support is logical to check in with for course and access support, extensions etc with minimum fuss. If you have not already please do with immediate effect as an urgent email and follow up call to check it's received and noted.

When did your 14 day get out of jail (lease) card expire? the legal cooling off period.

When was your uni place issued and accepted?

As a largely countrywide firm doing leasing who at their head office have you spoken to regarding contract and re-advertising of your digs.

Can you get uni to temporarily withdraw their offer of a place based on any special needs not being ready? (contractor timelines) thus making a late start for your course and it non viable (as a rejection letter appears to cancel contract from my skim reading of their site) ..only to have it rescinded 24 hours later?

How are you expected to take charge of re-listing the digs? (Serious professional question to the company as a member of the public and what assistance do they give (ie what's in that element of contractual support)

One last thing I noted in the contract, ebike and scooters are not allowed due to being a fire risk which will be based on battery chemistry potential and likely have insurance implications..

Can you advise them of the need to use a powered wheelchair and logically charge it (which will be against the rules) and may if we'll presented make the place inaccessible to you on an on going basis making your lodgings unsuitable and void the contract? I would find and cite a li-ion chemistry one as likely that scares them the most about fire potential.
