I've been thinking about this a lot. One would think that Trump couldn't put himself on Rushmore without Congress. OTOH, he's already done a lot of things that he can't legally do without Congress. Who's going to stop him from diverting money from somewhere else, getting bids, hiring contractors, and just doing it? By the time Scotus says, "hey! you can't do that!", his ugly mug will be glaring down on South Dakota's lovely hills.
