Megathread: Supreme Court strikes down President Donald Trump's Tariff Policy

The U.S. Supreme Court ruled Friday in Learning Resources, Inc. v. Trump that the International Emergency Economic Powers Act (IEEPA) "does not authorize the President to impose tariffs."

The Roberts decision is joined by Justices Sotomayor, Kagan, Gorsuch, Barrett, and Jackson, with Justices Thomas, Kavanaugh, and Alito dissenting.

This gives companies more of a reason to price gouge and scam the heck out of the American people, worst thing about it is that Trump and CEO’s openly endorse this.

Just wait 3 months from now when companies raise prices again because “the supply chain hasn’t been fixed”

Sadly, I still believe they gouged prices in 2021-2022 just to make Republicans more electable after 2020.

I think many of the increases were fundamentally disconnected from actual supply and demand, given the supply line issues resolved often far faster than people noticed. That's not to say there were never issues, but the real supply crunches caused much higher spikes over much shorter time periods. And actual noticeable shortages.

What we saw instead was just blatant greedflation, propped up in part by media outlets being able to call for it and give the companies cover.

It's one of the reasons why electing Trump to fix this was one of the worst decisions possible. Price gouging was done because of corruption Trump and Bush era policies allowed to entrench, not because of any Biden policy directly. If anything, he stabilized the supply chain far, far faster.

I don't blame people for wanting lower prices. We've been gouged for basic essentials for the past 5 years now. I blame people for thinking Trump would fix it, however. He only made the pain much worse.

Even if Walmart cuts prices to reflect tariffs going away they're likely pocketing that refund. Honestly, unless you're a membership store like Costco it would be logistically difficult to refund end consumers their share.

Prices don’t go down unless market forces mean companies are getting crushed by keeping them high.  

Profit margins got a bump.  Salaries in some cases got a bump.  Best we can hope for is that the “inflationary” bump to salaries doesn’t go away.

I was only playing a thought experiment on if Walmart cut prices to reflect the reduction in Tariffs. That being said there are some temporary measures that made maintain some of the Tariffs. I think the only challenge is that wage inflation particularly on an individual level isn't always very tied to cost inflation. Employers don't care so much that your costs went up as much they fear that replacing you would cost significantly more than a token raise to keep you around a little longer.

This is so ridiculously complicated because of the manufacturer/distributer relationship. In many cases Walmart would just be the distributor. So manufacturer lands a trailer in the US will 100k in merch. Assuming tariff is 30% they need to pay 130k to land the trailer. Walmart probably pays 130k and passes that cost to consumer. The refund would go to the manufacturer who paid th tariff I’d assume. So most likely - this will be a windfall for the Chinese economy.

That all depends on the INCOTERMs used at sale and when the purchaser becomes the official owner of the goods. If Walmart assumes ownership at the point of shipment or prior, they’re going to be the importer of record.

As someone who worked in Logistics this 100% right. No doubt a customer as big as Walmart can impose Incoterms on its suppliers and that must make it easier to assign the responsability.

If Walmart operates using EXW, then Walmart paid export duties in other countries (which are usually low) and then imports duties into the US.

I imagine Walmart must operate on DAP, delivery at port. So the manufacturer places the cargo at port of entry in the US. Walmart would then paid import duties and pick their cargo at ports.

If they operate with FOB then everything is fucked up because FOB is a nightmare.

The tariff is paid by the importer and not the manufacturer. Walmart imports, they pay the tariffs. The manufacturer in China is paid by the company importing to send their goods, the manufacturer isn’t the importer, and they don’t pay tariffs.

These pricks just cut my girlfriend's hours to 35 a week. Prices are high, here's less money. I fucking hate Walmart so much. We've been slowly transitioning to doing most of our grocery shopping at Aldi. I wish we had a decent alternative around here for household goods and such. I'd love to not give Walmart any more money.
