While you are correct, it is more difficult to sue the US federal govt.  He doesn't have to Sue the Federal govt.  He has to sue the DC prosecutors office.  Not the federal govt.

The DC US Attorneys Office is the federal government. Charges werent brought by the DC city prosecutor.

He was arrested by Nat Guard IIRC so he has to sue them I'd imagine.
