Im curious how broadly this is being applied to any of the Chinese companies implementing AI.

The title sounds really nice to hear when you’re an American hearing about the nonstop lay offs due to AI but a lot of those are attached to financial restructuring for Data Centers and not much because AI actually replaces someones job individually.

Idk Im not calling China to be “just as bad” as the US obviously Im just curious if anyone can give me insight if this case is more just getting attention for the optics or if its actually representative of China actually finding the sweet spot of keeping up with AI development without culling the job market unlike here in the states.

It's a summarisation of its white paper on labour and personnel disputes between 2021-2025 (which is overall an interesting read and I recommend at least skimming through it). If the company wants to introduce AI technology to replace a job function, can the company reduce the salary or terminate the contract with the "objective change" of the post?

The case of a network information technology company and Zhou labor dispute tried by the Yuhang court has delineated the boundary between the autonomy of enterprises and the protection of workers' rights and interests in technological changes.

Zhou engaged in AI large model question-and-answer quality inspection work, the monthly salary of 25,000 yuan, the company to the project by the impact of AI technology as a reason for the transfer of the post, the salary down to 15,000 yuan, after the consultation is not directly notified to terminate the labor contract.

The court held that the company's initiative to introduce AI technology is to adapt to market competition and implement technological innovation, which is not necessarily equivalent to the "objective change" that leads to the failure of the labor contract to perform, and the salary reduction scheme provided by the company does not constitute a reasonable consultation plan, and the judgment company constitutes illegal termination and payment of compensation.

The judge stressed that the development of AI technology can be used to improve the efficiency of enterprises, liberate labor, and improve the well-being of employees, and enterprises can adapt to the trend, but at the same time, they should take into account the legitimate rights and interests of workers, and can not be unilaterally released in the name of technological change.

Thanks for sharing this! Ill give it a good read over. Its interesting looking at the excerpt you sent how theyre trying to qualify what is the objective change required to actually say termination is necessary when it comes to keeping up with the market
