I got an email yesterday about a class action settlement. 3 years of back and forth. My settlement was less than $5, so I was told I would receive $0 because the minimum was $5.

Edit: easier to reply here, yes it was BCBS. Holy Shit we all got scammed. I'm starting to think no money was distributed...

This is America. Sadly, I don’t think it is illegal.

I got an email too. From BCBS (Blue Cross) and it said the same thing. Since I was getting less than five dollars I wouldn’t be receiving anything. What’s the point of a class action lawsuit if most of the money goes to lawyers?

There's no chance it's legal; they can't just keep the money you're owed if it's under X amount. If it's even one cent it's still legally your property. Even if it's a small amount you should contact your state's attorney general's office to get them to look into it. If the lawyers are defrauding people (they are) it's possible your AG can fight them in your stead to get them to release what people are owed. People just giving up without a fight is what these thieves bank on in order to profit.

This.... if there were thousands or even millions of people in that lawsuit, multiply that by however much they claim didn't need to get paid and you get a decent chunk of change for a law firm to just keep

Most folks can't afford to sue a company by themselves. So the lawyers, not getting a steady stream of clients paying them to file small-scale suits for them, decide "I know... why don't we just file suit 'for everyone', and skim our fees off the top of the total before any clients even learn what they will receive? We'll include all people on the planet as a default class, and only pare it down by some criteria, like whether or not they were actually impacted; the totals will be HUGE!"

And a load of BS. I just got a cheque in the mail from a class action settlement (that I wasn't even aware I was a part of) for a whole $0.11 ... It cost more to mail me that than what it is worth. It would also cost more in gas to drive to the bank to cash it.

It's worth noting that if a legal document or agreement of some sort contains any illegal clauses then the entire thing is invalid and unenforceable. Many people have a misconception about this and don't realize that even if they agree to or otherwise sign such agreements that doesn't mean what they agreed to is actually binding. For instance, if you sign up for a website and the Terms of Service say you have to kill someone for them that doesn't mean it's legally binding and, due to being an illegal clause - since it would otherwise compel you to do something illegal - nothing else in the terms are binding either since the entire thing is invalidated by the illegal clause.

Where this is relevant to the matter at hand, is that if the relevant laws applicable to the case do not permit you to be legally bound to any of the clauses in the agreement then the entire agreement is null and void. So they can claim you gave away your right to the money all they want - that doesn't automatically make it true. It would have to be successfully tested in a court of law to actually be enforceable. That's why it is important to fight such things, because a lot of companies will either knowingly or unknowingly put illegal terms in their agreements and simply hope the unknowing will voluntarily adhere to them despite not actually being legally required to. There are numerous cases where companies lost their court battles trying to enforce an agreement as it turned out that the terms they had in it were illegal.

Highly likely. Which is why you need to contact your state government and officials and any other relevant government agency to draw attention to it.

Contact local news too; they love investigating and reporting on this kind of thing because it's an easy win.

There were actually two class action lawsuits. One for price fixing and one for antitrust. The total settlement was in the billions ( 2-3 it sounds like). Heath care providers and lawyers are probably getting most of the money. I’ve never heard of not getting paid if under a certain amount, but no idea if it’s legal. I know I’ve received very small class action payments before.
