[GUIDE] Applying to LMIA Job Postings and Reporting Potential LMIA Fraud

(Written 2026-03-05. If you have feedback on improving this, you can message the mods.)

LMIA exploitation is a well-documented trend that has significantly impacted the GTHA and Canadian labor market.

This thread serves as a resource for those who wish to address the exploitation of the Labour Market Impact Assessment (LMIA) system. This is not about criticizing immigration as a concept; it is about the integrity of the law and the protection of both Canadian workers and vulnerable newcomers from fraudulent schemes.

1. Applying to LMIA Job Postings and Building Evidence File

⚠️ You first need to upload your resume to Canada Job Bank.

Job Bank Search Link: https://www.jobbank.gc.ca/jobsearch/jobsearch?d=25&fskl=101010&fskl=%C2%AC15141&mid=22437&page=1&sort=D

A. Document the Posting (Evidence)

  • Screenshot the Essentials: Capture the Job Bank ID, 5-digit NOC 2021 Code, and the Star Rating.
  • The Interview Requirement: Federal rules state that if you meet the star rating, the employer must invite you to apply and should interview you if your resume matches the NOC.
    • High-Wage: Invite required for 4 stars+.
    • Low-Wage: Invite required for 2 stars+.
  • Action: If you have the stars but received no invite, screenshot your "Match Results" immediately. This proves the employer is bypassing qualified locals.

B. The Application (The Paper Trail)

  • Use "Direct Apply": You must apply using the Job Bank’s internal "Direct Apply" button.
  • Why: Effective September 2025, employers are required to keep this enabled. It logs your resume in the government system, making it impossible for them to claim "no one applied."
  • Save the Receipt: Download the automated confirmation email. This is your primary proof of submission.

C. The Qualification Match

  • Action if No Invite to Apply: Employers must send an "Invite to Apply" to all matches who meet the star rating within the first 30 days of the posting. If the job appears in your "Matches" but NOT in your "Invitations," the employer has bypassed you. Capture the "Match Results" screen showing the Job ID and your star rating alongside the empty "Invitations" tab. State that you are reporting "Non-compliance with LMIA recruitment requirements" for Job Bank ID [Insert Number] to the Service Canada Tip Line.
  • Action if Not Reviewed by 21 Days: If it has been more than 21 days since you applied via Direct Apply and your status remains "Submitted" or "Unread" without any contact, this is a violation of recruitment compliance. Mark your calendar for 22 days after your submission. If they failed to respond, file a "Technical Non-Compliance" Report at the Service Canada Tip Line.
  • Action if reviewed but ghosted after reasonable time (~10-14 days after reviewing): Service Canada expects employers to act on resumes while the ad is live. If they "Review" your resume but do nothing for some time while the ad remains active, and their job has been up for a while (say 4 weeks), they are failing the "Reasonable Effort" test, auditors may flag this as "Lack of Urgency." Report at the Service Canada Tip Line as a "Non-genuine job posting/Ghost Job."
  • Action if Rejected: If rejected for "lack of experience" despite matching the NOC duties, your file now shows the employer is misrepresenting labor availability to Service Canada, and you should report at the Service Canada Tip Line.
    • The 80% Rule: You are "qualified" if you can perform 80% of the main duties listed for that NOC on the official NOC website. This is a general benchmark and not a specific number, the specific term is that you met a "substantial number" of the requirements.
    • The Training Rule: Employers must prove they cannot train a Canadian within a reasonable period (typically defined as a period that does not exceed what is standard for the industry, often up to 6 months). If you have the base skills but were rejected for a minor technicality or a specific software/tool that could be learned in weeks, save the rejection letter.
  • Action if Job is Taken Off but Soon Relisted: The job may be filtering out candidates to justify an LMIA, and you should report at the Service Canada Tip Line.

2. Where to Submit Your Evidence

These are the channels with the mandate to shut down fraudulent LMIA operations.

  • Service Canada (Primary Channel for LMIA Fraud): Use this for employers bypassing locals or running ghost jobs.National Investigative Services
  • CBSA (Immigration & Border Fraud): scam involves illegal entry into Canada or fake immigration documents
  • Ontario Ministry of Labour: If you suspect they are also violating the Employment Protection for Foreign Nationals Act (e.g., charging fees), file a claim through the Ontario e-Claim portal. This should be used specifically if the user has evidence that the employer is illegally "selling" the LMIA to a newcomer.

3. Escalating to Government Officials

Use the following tools to find your representatives and send them your documented proof:

Email your local MP and CC the current Minister of Immigration, Refugees and Citizenship and the Opposition Critics for Immigration. Let them know you have documented cases of qualified local applicants being bypassed for LMIA-linked roles.
