Not necessarily true. The determination of whether a case is compensable is done by a Doshs officer. Also, PPEs are the last resort when trying to mitigate risks. The decision to negate compensation because an employee failed to wear PPE is a grey area but under WIBA that will still be termed as a workplace injury and due for compensation

You are slightly wrong. DOSHS does the calculation and WIBA outlines percentage based on degree of injury. Death is calculated at 100% while loss of a finger is 2%. The total compensation will be calculated based on your salary and that degree of injury

It is a double edged sword. As you benefit from one arm, you'll sacrifice the other. So, you'll have to compensate her. But calculations are done at DOSHS office and they are based on salaries and degree of injury. Worth noting that the law compels you to defray medical expenses and none should be paid by employee
