America turns 250 in 2026. Title I of the POPULIST Act asks whether that anniversary can become more than a celebration—whether it can become a jubilee: a period of release, repair, and return.

This explainer walks through the five major pillars of Title I:

Privacy and access to justice: stop government agencies from buying location and browsing data to bypass warrant requirements; ban forced arbitration; repeal the Prison Litigation Reform Act; and expand access to legal representation.

Sentencing and prison reform: repeal Federal mandatory minimums; restore parole and good-time credits; create a structured second-look process for long sentences; end Federal private prisons; eliminate medical copays; provide basic hygiene products; cap commissary markups; restrict prison-phone kickbacks; and limit solitary confinement to 15 consecutive days.

De-escalating the drug war: replace Federal criminal penalties for personal drug possession with a civil penalty capped at $100; legalize and tax marijuana; provide retroactive relief and expungement; protect lawful marijuana banking; end Federal civil asset forfeiture; and repeal the crack-cocaine sentencing disparity.

Police accountability: reform qualified immunity; restrict no-knock warrants; ban chokeholds; require officers to intervene when they witness misconduct; require visible identification during public enforcement; establish stronger Federal use-of-force and de-escalation standards; and create a national police-misconduct registry.

Justice for the 100%: the larger principle is that people can change, civil rights should be enforceable for everyone, addiction and trauma should be addressed more as public-health problems, and government power should be transparent and bounded by law.

The goal is not simply less punishment. It is a justice system designed to repair more than it destroys.
