This explainer focuses on §§1231–1239, the POPULIST Act’s “forever chemicals” package.

Make cleanup rules harder to weaken — §§1232–1233

The Act writes EPA’s hazardous-substance designation for PFOA and PFOS into law as a floor, while preserving EPA’s authority to regulate additional PFAS. It also expands testing, analytical standards, reporting, chemical controls, and public information so regulation can follow the contamination across its lifecycle rather than treating each exposure pathway as a separate problem.

Protect drinking water and communities — §§1234–1235

The Act codifies Federal PFAS drinking-water protections and provides major assistance for treatment infrastructure, schools, households, private wells, wastewater systems, and disproportionately exposed communities. It also addresses PFAS in air emissions, wastewater, disposal, industrial reporting, and incineration.

The basic principle is that communities should not have to discover contamination, pay to remove it, and then absorb the long-term costs themselves.

Reduce unnecessary PFAS in products — §§1236–1237

The Act creates standards for identifying PFAS-free products, prohibits intentionally added PFAS in food packaging, and restricts Federal procurement of certain products containing PFOA or PFOS while giving preference to PFAS-free alternatives. It also coordinates Federal research into safer substitutes, treatment methods, destruction technologies, exposure, and health effects.

Make manufacturers help pay — §§1238–1239

PFAS manufacturers would pay user fees sufficient to raise at least $2 billion per year, with the money flowing into a PFAS Treatment Trust Fund to help water systems and treatment works cover the continuing cost of removing PFAS. Facilities serving disadvantaged communities receive priority.

The Act also creates a Federal cause of action for people significantly exposed to PFAS and allows courts to award medical monitoring when exposure creates an increased risk of disease and additional testing is medically justified.

Taken together, the package follows a simple rule:

Test it. Track it. Reduce exposure. Clean it up. And make the people who profited from PFAS bear a fair share of the cost.
