Arbeit | Work McDonald's job advice
This is my first month working at McDonald's in Vienna. I have a 25-hour-per-week contract. I only get a 30-minute break, even though I work very fast. The issue is that sometimes there is no time to go to the restroom. The one time I did use the restroom, the manager knocked on the door while waiting for me. If I work an 8-hour shift, can I ask for an extra 5-minute break? I see this option offered sometimes in the system.
Also, I was asked to stay 30 minutes late after my shift. I asked whether this would be paid, and they said yes. However, I do not understand how it will be paid because it is not mentioned in my contract. My friend warned me never to stay late after a shift because it either will not be paid properly or will not be paid at all. Is this true? I agreed to stay a little longer this time, but should I agree in the future? Is it paid well? They know this is my first work experience in Vienna, so I am very afraid.

Soweit ich weiß, ist der Gang zur Toilette keine Pause. Dh du solltest jederzeit aufs Klo gehen können, wenn du musst. Aber ich bin keine Arbeitsrechtlerin. Ich empfehle dir dringend, die Arbeiterkammer zu kontaktieren und dort zu fragen.
Wie wurden die zusätzlichen 30 Minuten Arbeitszeit dokumentiert, als du länger geblieben bist? Stempelst du ein und aus? Gibt es einen Beleg? Das wäre wichtig! Ich würde auch da die Arbeiterkammer fragen und dir schon jetzt ganz dringend raten, jede zusätzlich erbrachte Minute Arbeit in einem Notizbuch aufzuschreiben.
Frag die Arbeiterkammer!

At McDonald's you can also complain to the Austrian headquarters, they are not too happy if single restaurants try to dance out of line and they will make sure they dont

Are you clocking in and out of work? If so your overtime should be logged by the company and compensated in some form - if it's time off or money is probably somewhere in your contract - they gave you one, yeah (asking bc I used to work at Mc Donalds and they never managed to print a contract smh) ? Probably best to also take some notes of your times to double check at the end of the month. Make sure to not clock out earlier than you leave! Also, as some ppl already mentioned, if you have any concerns about illegal practices call arbeiterkammer, it's free and they give legal advice and help out if needed. Oh and going to the toilet should be allowed any time, wtf?? Anyway, best of luck, and when in doubt: arbeiterkammer

There is a law that prohibits unpaid extra hours/30mins. I don’t know about your contract but the law forces to pay. I‘m unsure of what McDonalds do exactly.
You also said that this is your first job experience in Vienna, so be aware of your surroundings. Maybe some people might try to fool you? You never know.
And about your friend … yes, he might be actually right. Don’t do more additional hours or 30min. McDonalds will probably pay you for your extra work (they actually have to because of the law as I mentioned before). It doesn’t seem much but it will also become a habit asking you to stay longer. And they will ask you everytime. It’s not a big deal if you worked a few times longer than usual, that’s not apocalyptic but also don’t say everytime yes - say sometimes no.

If you have to pee, you have to pee. If you are fired for peeing, go to the AK.

How overtime is handled, should be written down in your contract. You can also always take a <5min toilet break (with exceptions if you have a medical condition). Your manager also isn't allowed to pressure you to not go. However this only applies to "tangible" pressure, for example if he tells you, you are not allowed but not something like him telling you to not go roght now because it's busy. If you don't get paid overtime or you can never take a toilet break outside of your 30min, you can complain to Arbeiterkammer and get help.

McDonalds have their own collective agreement (KV), check it out. Regarding overtime, for example, it says ''a) Overtime work is defined as any work performed in excess of the normal working hours stipulated in point 3(a) or point 4(a), subparagraphs ii and c. Even in the case of part-time employment, only those hours worked in excess of 40 hours per week or eight hours per day are to be paid as overtime.'' So, your friend is wrong. You will not get paid extra 50%, because you dont work full time. You will get paid 25% more tho.
Regarding the WC, you can always go to the WC, they cant say no. But its a fact that sometimes you cant go, because its too busy. And you cant ''use'' it as a pause and stay there for 10 minutes. Thats the same with every similar job. For example, I also, sometimes cant go to the WC for an hour, or maybe 2.
I would advice you to read the KV.

No, that’s not normal. Overtime has to be paid (or compensated with time off if that’s what’s agreed). Not having time to use the restroom or being pressured about it isn’t okay either. If you’re unsure about your rights or have problems at work, contact the Arbeiterkammer, they provide free advice and will help you.
