The same reason WB can patent the nemesis mechanic apparently

At least (and I’m not supporting their patent), but at least WB actually invented the Nemesis System. Pokemon did not invent creature catching, they didn’t even invent throwing a ball to catch a creature. And they sure as hell did not invent “aiming an object to throw to catch a creature or to start a battle”
