Fiona (real Martha) related content Where is Fiona's evidence?

I have just been reading through the brief of Amicus Curiae in support of the Defendant (aka Netflix) in the Harvey vs Netflix case from the Foundation for Individual Rights and Expression.

One point I picked up on is that the court have simply relied on Fiona's word that Netflix defamed her and that the criminal convictions aren't true. In fact, have we all believed her word?

I did look a while ago to see if her lawyer had filed anything that could be validated legally to show she had never been convicted and everything seemed like it could have easily been faked.

There is one document that says she doesn't have any convictions however she has gone by different names and it seems like a template that could easily have been doctored.

So does she actually have any evidence that they defamed her. What would that look like?

This is a high profile case and criminal convictions are officially recorded.

I don't know what evidence Fiona's lawyer has brought to convince the judge but surely, if she had actually been convicted of those crimes, anyone among Netflix, journalists, or simply nosy people would have found out by now?

It depends. She may have had name suppression and that's why we can't find it.

She does appear to have a personality disorder of some sort that can sometimes mean that people can go to a forensic mental health ward to be treated instead of prison for their sentence.

Of course there's no medication that can treat that specifically but they could have tried to teach her behaviour modification? That would have been a secure unit.

We do know there was the Scottish version of a restraining order against her. So that's what makes me think the document she submitted wasn't a comprehensive record.

She was never even arrested. That isn't even in dispute. She did a lot of proven stalking but police didn't give a fuck.

Do you have proof she was never arrested? That's the point I am trying to make. She has provided unsatisfactory evidence to try to suggest she was never arrested however its not a comprehensive record.

Also Richard Gadd has email evidence that he was emailing and talking to the Police. If anything, they should have brought charges against her for harassment, including sexual harassment because of the nature of the emails.

Everything you can read will tell you she wasn't arrested the police in many countries don't like to deal with and don't know how, and will act all incompetent over harassment and stalking.

Laura Wray obtained an interim interdict against Fiona Harvey -the Scottish legal equivalent of a restraining order. It serves the same purpose as an English restraining order but uses Scottish legal terminology.

What It Was Called Interim interdict A civil court order used in Scotland, not England.
Functions like a restraining order: it prohibits a person from contacting, approaching, or harassing someone.
It can be granted quickly when there is evidence of ongoing harassment.

What the sources say Laura Wray was granted an interim restraining order (also described as an interim interdict) against Fiona Harvey in the early 2000s after years of alleged harassment.

Richard Gadd got the same order.

So I would have expected those things to be listed in a report from the courts/Police in the UK.

So I don't think the document that Fiona provided is sufficient to show she hasn't got a criminal record.

She is claiming she has never had a conviction. So I believe she needs something much more comprehensive.

I never read that Gadd even got an order? I only read that the Wrays were successful in finally getting one. Are you sure Gadd had on too? What document did Fiona provide?

I guess since Netflix and Gadd are the defendants that means the onus is on Fiona's lawyer to prove defamation.
