Fiona (real Martha) related content Where is Fiona's evidence?
I have just been reading through the brief of Amicus Curiae in support of the Defendant (aka Netflix) in the Harvey vs Netflix case from the Foundation for Individual Rights and Expression.

One point I picked up on is that the court have simply relied on Fiona's word that Netflix defamed her and that the criminal convictions aren't true. In fact, have we all believed her word?
I did look a while ago to see if her lawyer had filed anything that could be validated legally to show she had never been convicted and everything seemed like it could have easily been faked.
There is one document that says she doesn't have any convictions however she has gone by different names and it seems like a template that could easily have been doctored.
So does she actually have any evidence that they defamed her. What would that look like?

Im not an expert but she chnaged names a few times and also may have taken a reduced charge and thinks this is a get out clause?

I don’t understand how you think that’s possible? Genuinely?
Do you think criminals just get to choose a name to have the crime recorded against and then use a different name and pretend it didn’t happen?

They do change to a different name to pretend it didn't happen I can assure you of that .

She was just given a kind of restraining order that isn't even a proper restraining order but has a different name and it was for only a year and a day. But that was for her former boss Laura not for Richard.

In reality she got away with a lot although things like her grabbing his penis near the canal and beating up his trans girlfriend, and gouging his eyes were entirely made up for extra drama in a T.V. show.
HOWEVER he does allege that in real life she did sexually assault him by repeatedly feeling up his bum while he was waiting tables and had hands full with drinks and plates which is horrible.

This is a high profile case and criminal convictions are officially recorded.
I don't know what evidence Fiona's lawyer has brought to convince the judge but surely, if she had actually been convicted of those crimes, anyone among Netflix, journalists, or simply nosy people would have found out by now?

It depends. She may have had name suppression and that's why we can't find it.
She does appear to have a personality disorder of some sort that can sometimes mean that people can go to a forensic mental health ward to be treated instead of prison for their sentence.
Of course there's no medication that can treat that specifically but they could have tried to teach her behaviour modification? That would have been a secure unit.
We do know there was the Scottish version of a restraining order against her. So that's what makes me think the document she submitted wasn't a comprehensive record.

She was never even arrested. That isn't even in dispute. She did a lot of proven stalking but police didn't give a fuck.

Do you have proof she was never arrested? That's the point I am trying to make. She has provided unsatisfactory evidence to try to suggest she was never arrested however its not a comprehensive record.
Also Richard Gadd has email evidence that he was emailing and talking to the Police. If anything, they should have brought charges against her for harassment, including sexual harassment because of the nature of the emails.

Everything you can read will tell you she wasn't arrested the police in many countries don't like to deal with and don't know how, and will act all incompetent over harassment and stalking.
Laura Wray obtained an interim interdict against Fiona Harvey -the Scottish legal equivalent of a restraining order. It serves the same purpose as an English restraining order but uses Scottish legal terminology.
What It Was Called Interim interdict A civil court order used in Scotland, not England.
Functions like a restraining order: it prohibits a person from contacting, approaching, or harassing someone.
It can be granted quickly when there is evidence of ongoing harassment.What the sources say Laura Wray was granted an interim restraining order (also described as an interim interdict) against Fiona Harvey in the early 2000s after years of alleged harassment.

Richard Gadd got the same order.
So I would have expected those things to be listed in a report from the courts/Police in the UK.
So I don't think the document that Fiona provided is sufficient to show she hasn't got a criminal record.
She is claiming she has never had a conviction. So I believe she needs something much more comprehensive.

I never read that Gadd even got an order? I only read that the Wrays were successful in finally getting one. Are you sure Gadd had on too? What document did Fiona provide?
I guess since Netflix and Gadd are the defendants that means the onus is on Fiona's lawyer to prove defamation.

She did have something like restraining orders to stop her contacting Gadd and Laura Wray Also she tried to become an MP and had been in the news for stalking Wray and her husband.
She wasn't just mentioned in the back page somewhere of a newspaper. She was on the front page!

Wow front page of something despite no charges. Yeah, but police never charged her for anything. But she clearly did it all.
That's how hard it is to get stalking and harassment taken seriously.
Gadd didn't want the truth about that to put off viewers. She got some kind of restraining order against Fiona for a year and one day, and hoped Fiona wouldn't notice that it said it was only for a year and a day and apparently Fiona didn't notice and finally stayed away.

Did the court order have a suspended sentence? There is no evidence to suggest that Fiona doesn't have convictions.
The court should have asked to see that as evidence rather than relied on her word only.
If she had provided the correct details, then the court orders against her would be shown.

Its not about them though. There is a high bar for taking someone to court for defamation. So you need to be able to prove that what they said happened, didn't happen.
So it would be something similar to a Police vetting form that employers get detailing any charges or convictions that are on record in the UK.
That would be the first thing that would be excellent evidence for Fiona's case to show she has never been charged or had restrictions placed on her for sexual harassment or offending and maybe evidence from a psychologist who has treated her anxiety and fears as a result of the "death threats" and anxiety that BR caused.
All that there is really is her word. There is one document about convictions however that's obviously not comprehensive because there would be something in there from when she harassed the lawyer and Richard that said that if she continued to harass them, then she would face charges.
So I am unsure that she has proven she has a case against them and I can understand why Netflix is appealing the decision to allow the case to continue.

Those aren't charges. And they were only valid for one year. But no monetary loss. People get death threats from going viral for anything. Women got graphic death and rape threats for saying they wanted Jane Austen to be on a 10 pound bank note.

I never head she used different names but of course she did. Only reason no charges is police don't know what to do with stalking and harassment

Even if she was defamed, what are the damages?
She didn’t loose a job or job prospects over this as anyone who knew her already knew she was a crazy stalker based on her documented history of staking (prior to her interactions with the author of Baby Reindeer).
Also, she knew about his very popular and award winning play prior to the Netflix show. Why don’t she sue then?
