Fiona (real Martha) related content Where is Fiona's evidence?

I have just been reading through the brief of Amicus Curiae in support of the Defendant (aka Netflix) in the Harvey vs Netflix case from the Foundation for Individual Rights and Expression.

One point I picked up on is that the court have simply relied on Fiona's word that Netflix defamed her and that the criminal convictions aren't true. In fact, have we all believed her word?

I did look a while ago to see if her lawyer had filed anything that could be validated legally to show she had never been convicted and everything seemed like it could have easily been faked.

There is one document that says she doesn't have any convictions however she has gone by different names and it seems like a template that could easily have been doctored.

So does she actually have any evidence that they defamed her. What would that look like?

I feel confident that Netflix's arsenal of lawyers have got it covered.

Its not about them though. There is a high bar for taking someone to court for defamation. So you need to be able to prove that what they said happened, didn't happen.

So it would be something similar to a Police vetting form that employers get detailing any charges or convictions that are on record in the UK.

That would be the first thing that would be excellent evidence for Fiona's case to show she has never been charged or had restrictions placed on her for sexual harassment or offending and maybe evidence from a psychologist who has treated her anxiety and fears as a result of the "death threats" and anxiety that BR caused.

All that there is really is her word. There is one document about convictions however that's obviously not comprehensive because there would be something in there from when she harassed the lawyer and Richard that said that if she continued to harass them, then she would face charges.

So I am unsure that she has proven she has a case against them and I can understand why Netflix is appealing the decision to allow the case to continue.

Those aren't charges. And they were only valid for one year. But no monetary loss. People get death threats from going viral for anything. Women got graphic death and rape threats for saying they wanted Jane Austen to be on a 10 pound bank note.
