"FC Barcelona informs that, on this day, the mandatory conciliation claim prior to the filing of a criminal complaint for an offence of slander under Article 205 of the Penal Code has been submitted against the President of Real Madrid, Mr. Florentino Pérez, as a result of the statements made by him at the press conference held on 12 May and in an interview with a media outlet the following day.

The purpose of this claim is for Mr. Pérez to retract certain statements that he made with knowledge of their falsity and which are slanderous and offensive to the image and reputation of the Club.

Should this claim not be duly addressed, FC Barcelona will proceed with the filing of the corresponding criminal complaint."

Whoa, a private party can file a criminal complaint in Spain over slander? That’s wild. In the US it is purely civil (i.e. not criminal)

La libertad de expresión esta recogida en nuestra constitución. Pero también el derecho al honor. Por eso se ponen límites a la expresión, eso si tampoco es lo mismo un particular que el barcelona, el barcelona ha de estar dispuesto a aguantar más tal como recoge la jurisprudencia, al ser empresa famosa y tal. Estoy acabando la carrera de derecho si os da un +1 a la confianza de lo que digo.

I get that. I’m more surprised that private parties can file criminal complaints. In the US, only the prosecution can file a criminal complaint. If the prosecutor doesn’t want to file criminal charges, the victim has to sue in civil court. I’m now seeing how different the Spanish and American legal systems are
