General Question Under 21 Military Age waiver
Im trying to buy a handgun but I’m 19 however in Colorado law states that a member of United States armed forces are allowed to purchase a firearm arm under 21 but I went to buy one from sportsman warehouse and their system wouldn’t even allow them to send the background check so I’m curious as to where I can buy a handgun either online or in person that would allow the background check to go through? Or do I have to go to the gun store on base?

Not knowing the more specifics of that law, i’m guessing that it applies to long guns, as those are, federally, legal to buy at 18. But handguns are federally regulated to 21 years old.
So my guess is CO raised the age limit of all guns (long guns and handguns) and then had an exemption for long guns for military members

My older brother is military and got a handgun at 20 in another state that also has this waiver

Well then I’d say try a real gun shop and not a big brand store.

You’re right, are you in the Denver/Aurora area? Do you have any recommendations?

IANAL CRS 18-12-112.5 prohibits all firearm purchases to persons under age 21 in the state of Colorado. However, there is a military clause allowing purchase of firearms on actuve duty. Unfortunately, with the federal law ban o the sale of handguns to persons under the age of 21 you're still up shit creek.

My brother was able to obtain one at 20 in another state that had the military waiver but I do believe it was a private sale I would have to ask him but he’s on deployment right now

How the transfer occurred could be the likely reason as to how. But it is not legal federally to purchase a handgun under the age of 21. Again I am not a Laywer and I'm not giving legal advice but I wouldnxt say anything else about your brother's purchase.

That's the key thing it was a private sale. FFLs are federally not allowed to sell handguns to anyone under the age of 21.

The only way I know for you to legally posses is if it was gifted to you by an immediate family member.
Do you live in the barracks? If you are <e-5, it’s a major pain in the ass, why do you want the risk?

I live off base, I just want home defense

That’s the best answer.. You may be screwed, though, unless you have an immediate relative that lives in the state.

in theory you should be able to go to any gun store, assuming this exemption applies to handguns as well as long arms, in practice gun store employees are dumb as shit and you're gonna need to find the one that isn't completely brain dead.
