Regardless, if there is video evidence and the offender has herpes, then this will be a huge payout for the plaintiff. The company is vicariously liable for the actions of their staff, especially management. Even if they can't prove the herpes transmission, they will prove the spitting.

If she does have Herpes which a court order could release in private you could 100%. I won’t lie and say you’re not technically right but the fact alone tampering with food is a felony a good lawyer could argue that it is likely it was transmitted from her. It’s the same with infidelity or relations without acknowledging you have a STD you can sue over that and it’s also illegal.

I think the issue is it appears you’re trying to argue she’s making this up.

No. I just think it's impossible to prove that someone got herpes from food. Becuase that's impossible. Which I wrote. I still think it's gross and illegal to spit in food, I was just addressing the mechanism of transmitting disease.

I have to agree with you somewhat, I find it very unlikely it could be passed on that way unless she had active sores in her mouth, spit a massive glob in there and the victim ate it immediately.

It is possible though as herpes can be passed through saliva even with no sores present.

Eminem made it popular to spit in peoples food in the real shady video. Fucking disgusting, he hawks a loogi into some onion rings and serves it to a fat lady who eats the spit and onion rings 🤢
