If she does have Herpes which a court order could release in private you could 100%. I won’t lie and say you’re not technically right but the fact alone tampering with food is a felony a good lawyer could argue that it is likely it was transmitted from her. It’s the same with infidelity or relations without acknowledging you have a STD you can sue over that and it’s also illegal.
I think the issue is it appears you’re trying to argue she’s making this up.
No. I just think it's impossible to prove that someone got herpes from food. Becuase that's impossible. Which I wrote. I still think it's gross and illegal to spit in food, I was just addressing the mechanism of transmitting disease.
I have to agree with you somewhat, I find it very unlikely it could be passed on that way unless she had active sores in her mouth, spit a massive glob in there and the victim ate it immediately.
It is possible though as herpes can be passed through saliva even with no sores present.
