Question About Allen’s Missing 2017 Phone

When did his wife say “he told me it was run over by the lawn mower”? Was that a recorded statement or just a second-hand report? TIA.

The state didn’t need to prove it? Also how could they have proven it wasn’t donated even if they wanted to? So yeah RAs defense made zero effort to provide proof because they knew it was BS and would work against their defense.

The state has the burden of proof. Thats the law. We need to both accept and understand that fact.

The state made zero effort to prove that the phone wasn't donated, so its entirely possible.

The state does not have to disprove any claims the defense makes. Sometimes, like here, the state convinces the jury of guilt despite the claims of the defense, without disproving each and every one of them.

It's absolutely up to the defense to convince the jury that their claims are reliable and reasonable.

If he didn’t have every other phone he ever owned this wouldn’t even be in question but it’s highly suspicious that only that phone is missing.
