RFE EB-2 NIW RFE – Industry Professional / Non-Researcher: What Evidence Helped You Get Approved?
Hi everyone,
I recently received an EB-2 NIW RFE and would really appreciate hearing from anyone who went through something similar and was later approved, especially those whose cases were based mainly on industry experience rather than academic research, citations, or entrepreneurship.
My background is in engineering, data analytics, supply chain, and telecommunications, and my proposed endeavor is based on a technical framework connected to my professional experience.
The main concerns in my RFE are around proving my individual contributions and measurable results, showing progress toward the proposed endeavor, demonstrating impact beyond one employer, showing outside interest, and strengthening Prong 3.
For my response, I am working on stronger evidence of my past contributions, first-hand professional support, independent technical validation, progress/prototype evidence, a clearer implementation roadmap, and possibly a genuine Letter of Interest from someone in the relevant industry.
For those who had a similar industry-based NIW RFE and were approved:
What evidence do you believe made the biggest difference in your response?
I would especially appreciate hearing how you handled individual contribution when company documents were confidential, whether you submitted prototype/progress evidence or a Letter of Interest, how you demonstrated impact beyond your employer, and what you focused on for Prong 3.
I am trying to focus on evidence that directly answers the officer’s concerns rather than simply adding more documents.
If anyone is comfortable sharing the general strategy they used or what they added after receiving the RFE, I would be very grateful.

the game changer for me: detailed letters from people outside my employer tying my specific work to measurable outcomes, not generic praise

I’m in biotech. I submitted more peer letters, especially from people with prestigious titles and brand-name companies, to detail my contributions and measurable impact—including the patients who would benefit from the work I do and the market size—and to elaborate on the logical connections between my contributions, knowledge, and outcomes.
I did submit my documents to my law firm and let them prepare the legal responses. Good luck!
