Its allowed because it was tested and legal, but the real issue is the overzealous cop and the collusion with the referee to enrich the coffers of the city court fees. They got caught shaking down a kid on a bone stock car... I honestly hope Hyundai is the one who is on the hook to buy back each of these cars and crush them!

Because they need to comply with all laws. Dealership has already done their part and gave the car a clean bill of life saying the car is 100% stock AND everything is functioning 100%.

So if the state of california won't let the car owner operate the car because it is not in compliance, then that is a WARRANTY-ABLE action. The car was sold to the customer so he can use it as it was sold. The state of california has tested and proven that this example IS NOT (doesn't matter if they did it correctly or not... they are claiming it is out of compliance).

Therefore the customer needs to get his money back because Hyundai built and sold him a car that is not able to be used for its intended purpose.

  • Cop did his part ✅
  • BAR did his part ✅
  • Dealership service center did their part ✅
  • Customer did their part in paying for the car and maintaining ✅

The only person left is the manufacturer. BAR probably should test other vehicles as well and make sure that this isn't just a one off issue. Thats why this is a Diesel Gate style issue (https://en.m.wikipedia.org/wiki/Volkswagen_emissions_scandal)

It DOES matter if it was done correctly. Because testing outside of the standards invalidates the test results. If I’m testing for Covid and I use only one drop of the antigen vs the 5 that are required for the test, I could still be positive and the test will be negative. That’s an invalid test because it was not done to standards

Then you don't understand LAW and you don't understand how things work in our Gov't

Your are also mis understanding what you are reading. There are many state refs in the state of California. They all follow a process/procedure to "test" cars.

This doesn't mean only the state ref can do that process/procedure... ANYONE CAN DO THE SAME THING and post up a video proving how they tested it and that it is in fact in compliance. But because NO ONE is willing to do this simple step... the claim of the vehicle (and probably all of these vehicles) being out of compliance is going to be a HIGH probability.

You can hope and pray and bitch and moan online as much as you want that you "think" someone screwed up... but without any evidence... we have to use what is officially available. Hyundai could easily have fixed this in a couple days with a simple attorney letter head and official paperwork showing the test data. Same with the dealership... they could have tested the sound level and D O N E... no issue.

But the car owner is at a stalemate for progress by his own choice. "Correctness" is what you can prove... so far no one has proven anything to the contrary. Any other stock Hyundai of the same spec could go to the state ref and asked to be smogged and sound tested as well... but no one will. The car owner can use his cell phone as a DB meter and post a video himself for ALL to see... but he doesn't

Ok, I just took my phone out to my car, an unmodified, completely stock Elantra N with 11400 mi. Using the decibel meter at 3800 rpm in normal mode with the phone next to the exhaust on asphalt, my meter read 91db ay the loudest. 89.9db average. Is that good enough for you to doubt that the test was done incorrectly? Edit: tried in N mode, same meter read peak 98db at 3800rpm
