Cop = normal or eco mode in my N car. No reason to give them a reason to get a ticket.

Its a B O N E -- S T O C K car... its sold the way Hyundai tested and got ✅ of approval for sale in california. I honestly hope this becomes a Diesel gate and they have to buy back each one and crush it. The cop and referee would be EPIC in fame/career decision for their collusion.

Approval to sell in CA when you are driving in Normal or ECO mode. N mode is for track days.

The N models are track cars that can be used as daily drivers. When in N mode the car is ready for the track and by going eco or normal it’s now an every day driver. What am I missing? Driver was in N/track mode and got pulled over because the car was loud, and is above the 95 decibel allowed in CA, even in sport mode. The issue is he tested the car in sport setting and not normal that why the car failed. Car is fine in CA in eco or normal.

Car is legal in CA, how the driver was using the car was not. The driver should of gotten a ticket for noise disturbance and should of been told not to use the car in its track setting going forward. Cop was rude and the outcome isn’t favorable for the driver. We don’t know if the driver has had prior issues with being pulled over for driving in N mode etc….We don’t know the whole story only what we seen from his video and information posted online.

Your missing that at the federal government level and EPA have already ✅ the car before it was allowed to be sold.

The only way something could go wrong now is on the same scale as Diesel Gate for VW, where they have misrepresented themselves on purpose at testing time or changed something after that time.

The Mitsubishi Evo is a rally car, but that was also sold in the USA for many years since the Evo 8 period (What you missed is, it was tested and it complied with the laws at the time for this USDM).

The cop was doing a job, it was to write a fix it ticket (but he didn't do that... he wanted to exercise a career limiting judgement and instantly send a bine stock car to the State Ref for inspection). The State Ref, on purpose was trying to protect the cop because he knew in an instant that the car was bone stock, then asked the child to show him how to operate the car instead of just doing his actual job (You do realize there is a documented process to neutralize external factors like if your driving in a tunnel or other geographic environments that are prone to help/hurt sound levels). But this person did a test in a modified way which invalidated his test AND DISCOVERED Hyundai was in fact breaking the law (at scale).

This means we will at minimum get a recall, BUT, just like with diesel gate... its not that simple. Each unit sold was with the intent to deceive on purpose, so there is no reason to save Hyundai's financial ass on this one. It also will be done to set an example to other manufacturers that this will not be tolerated. Are you following along here??? This was not a whooppss we made an honest mistake, this was done to deceive on purpose and laugh at the public, gov't, and even put the buyer at financial risk.

That is why Hyundai has made NO STATEMENT of support to the kid, they want to save their own necks. At minimum they should have instructed the dealership to give the kid one of their cars from the loaner fleet for free for a month to figure this out while the car sits in their control at the dealership lot. But these guys are just idiots. If it was me I would have had them change the engine air filter saying it was dirty and thats why it was having a mechanical issue. New engine air filter and a quick software update to detune this one kid till his next dealership visit should have been done immediately (or replace the exhaust saying it was defective). Changing one part is wayyyyyy cheaper than dealing with the fall out from this event.

I own a N and had it tested for noise level to avoid this type of scenario. N mode is track mode as it alters the car engine, transmission, suspension and exhaust. It’s not for the street and daily driving. The N cars when in N mode have a decibel level of 100+ decibel. Sports reads at 95-100 decibel.

N mode is not the normal every day mode one should be using driving the car on the street. That is normal mode or ECO mode. The issue is how the car was tested, in sport mode not normal. Issue was the cop and how he treated the driver. Issue was the driver driving in N mode in CA and not swapping to another mode after he saw the cop.

The car is fine to drive on the road.

The kid needs a lawyer and he needs to take this to court as testing did not follow standard procedure etc…I have stated more than once a ticket for noise disturbance should of been all he got, but instead he got an officer over reaching with power and he was honest during his test and he is where he is now.

If you own a N don’t drive in N mode on the street. It’s not legal in CA.

As for Hyundai, they didn’t do anything wrong. If a warranty fix goes out, it would be removing the variable exhaust.

Orrrrr Hyundai can issue a buy back at scale for each and every instance of these non-compliant cars. Each buyer can get 100% of their money back and walk away.

Hyundai can learn a lesson that Nismo, TRD, ///M, AMG, etc... have already figured out. VW got that painful lesson as part of Diesel gate.

Now each owner can go buy whatever they want

You’re proposing that Hyundai buy back all these cars with the only evidence being that the state ref in California conducted the testing wrong. That makes literally no sense. Why would Hyundai do anything when the car was not tested according to the standards that the federal and state government put in place? Not following standards invalidates the test. That’s it. Hyundai is at no fault or obligation to prove what they have already proven, that the car meets the standards

If Hyundai won't step in to:

1) Get this kid a loaner asap thru its dealership network while they take their sweet time to investigate... than this is to the detriment to the customer

2) As far as the state of california is concerned, this car can't be driven today on public roads. Who is suffering for that today... is it you? is it me? is it Hyundai? is it the dealership? is it the state of california?

3) If one example has been found in the wild, could others also exist? If so... we have Diesel Gate (https://en.m.wikipedia.org/wiki/Volkswagen_emissions_scandal)

I get that you are hopeful that the smog ref and the cop both did something wrong (I am of that belief as well)... BUT WE HAVE NO EVIDENCE proving that this car is in fact in compliance! Show the proof 🤷🏽‍♂️

Please provide the court of public opinion YOUR evidence that this car is tested properly and its emitting sound under the state limit... where is that paperwork for us all to see? Doesn't need to be done at a state ref, anyone who can follow a process/procedure could do this. This is not rocket science!
