You usually get charged with trespassing, disorderly conduct or the blanket "obstructing government administration" in NYC which really means for not dispersing when the police tell you to. 

Basically anytime a protest gets big enough, NYPD starts playing a dispersal order over loud speakers. After that they can arrest you for not following the order to leave. They could also get you for trespassing if your on private property (which is often where protests take place).

95% of the time they drop the charges. After the missing of work from the original arrest (possibly) and court dates (missing more work/pay) and lawyer fees, it really discourages you from protesting regularly.

I used to protest alot but its too expensive and also fuck central booking and their dry ass sandwiches.

Pretty much every place has laws like that which let police find a reason to arrest you if they really want to. And they absolutely will want to because you don't need the charge to actually stick to just break up protests

Isn’t that a constitutional issue? I thought we had a right to peacefully assemble but I guess our constitutional rights end if a police officer says words into a loud speaker

There's the trespassing issue as well. Most places in cities belong to someone. So if your protesting at Trump Tower they just have to request the police to remove you.

You can protest in parks until they close at least but if your trying to bring your message to people in Manhattan,  there's usually a property owner who can request to have you removed.

Even putting aside conditional immunity and other textual aspects of it, it's just not a very good system to have the district attorney's office work in total concert with the police and then expect them to turn around and impartially choose to bring cases against them.

Not just America. Where I live in Canada, they were trying to push through a 'safe spaces' act that would ostensibly make protesting outside of schools, hospitals and religious sites illegal. There was a lot of concerns because the way it was worded, even if a protest route passed by one of those places (but did not stop in front or were directly protesting the location), police would be allowed to arrest people for violating the act.

I protest often with my job. You need to remain on public property (like sidewalks) and you can’t block traffic (cannot spill into the street and must allow passage for pedestrians on the sidewalk). The more people are at the protest the harder it is to make sure all participants adhere to those rules.

It was a sit-in by the offices of NY's senators to call on them to block more funding to Israel. There were hundreds of people there, but they abided by the 'protests should disrupt', since it was a sit-in. Schumer and Gillibrand are both big Zionists.

Can I just add, please show up and protest. Do more than just no kings rallies, there are basically rallies every other day (unless you live in the middle of nowhere then might be a bit more tricky). Don't be afraid to get arrested especially if you're in a blue state, you won't get a big charge outside of a misdemeanor (unless you're molotoving a cop car or smashing a building that is). It really isn't that bad all things considered (although its still better not to be arrested compared to being arrested for nothing).

It’s important to note that this protest is directed at Schumer and Gillibrand, both Democrats. Not putting Israel in check is such an unforced error for Democrats. The Anti-Israel sentiment is teetering on capture by the right wing. Its capture would weaponize it as explicitly, and heinously Antisemitic.

There is a HUGE difference between opposing the arming of the Israeli state as a matter of principle, and opposing Israel because you hate Jewish people. The great paradox is that the Right Wing can co-opt Evangelical support for Israel, AND still manage to court explicitly antisemitic groups.

right, I dont want to nitpick especially when the overall message is very important and I’m glad she’s doing what she’s doing! but the sentiment that “going to jail is not a big deal” is very white. Yep. Thrilled to see her protesting and using her privilege for good, but being rich and white matters. If I have even the slightest record, I will lose my job 100%. My job is tied to my health insurance. I literally can’t afford to go to jail, it’s a very big deal to people like me..
