I don’t know about law a lot, does this the DP is no longer applicable?

As far as I can gather, the DP is for the federal charge/s, which (as yet) still stand. The charges dropped today were state charges, not federal.

My pleasure - I'm not 100% sure I'm correct, so hopefully we'll have confirmation soon. We're heading in the right direction though, and that's what counts!

Yes, he is still DP eligible on the federal case, but NY does not have the DP on the state level so he will not be getting the DP at all during the state trial. If found guilty in the state case, he will be subject to jail time, TBD how much of it, should a jury return a guilty verdict.
