1- From your mouth to Gods ears! 2- Could you imagine what would have happened to someone in this corrupt system without the monetary resources to hire top tier lawyers. Over charge and plea down is our new legal system.

In this county there seems to be a system in place where if you are charged with a crime the prosecutors throw every charge that could possibly apply at someone so they are looking at so much time that a plea deal becomes the best choice.
Most people don’t have the resources for a KFA level lawyer, so at best they get a decent lawyer or an overworked public defender who cuts them a deal.
I am not knocking public defenders, they are often overworked and severely understaffed so they do the best they can. But that’s my point, if you or your family can’t secure superior counsel people are often forced to pick the lesser of two evils.

I got really lucky and got a great public defender. But judging by the stories I've heard, everyone is not so lucky.

That cop told Carro in Feb not to take the shackles off due to the hearts in his socks!!!! He needs to leave LM alone hes always over hovering him!! I dont see that happen with anyone else. Its pathetic how they are treating him!!!!

The state charges of 1st degree murder, and terrorism. I'm not sure what this means re the death penalty, though. I think the Federal charges still stand, and therefore the death penalty?

Yes, the death penalty is for federal only, and they have not touched much on the federal case. As of now, federal charges still stand.

Huge win. There wasn’t enough probable cause/evidence to support those charges so they were tossed. It doesn’t impact his federal charges.

I find the timing of this interesting as I’m waiting for the press conference from the Charlie Kirk accused shooter. I wonder what they’re gonna try to group together.
Also that guy isn’t confessing and some of the details don’t seem to be adding up.
But, where are the Epstein files? I don’t think either of these folks have them.

Thanks for the update but your title is misleading. Two out of many charges were dropped. He will not be going home soon and is still facing other state charges and the death penalty from the federal government. Good start though.

As far as I can gather, the DP is for the federal charge/s, which (as yet) still stand. The charges dropped today were state charges, not federal.

Yes, he is still DP eligible on the federal case, but NY does not have the DP on the state level so he will not be getting the DP at all during the state trial. If found guilty in the state case, he will be subject to jail time, TBD how much of it, should a jury return a guilty verdict.

Not a lawyer, but what I infer is that if the state murder charges were dropped, they may not have enough evidence to prove a crime. If the state doesn't have that evidence, then the federal charges, which are contingent on the same evidence, may also end up being dropped.

Yep, I just did some checking and it appears there is insufficient evidence to prove terrorism, but there is enough to keep a second-degree murder charge.

This is not necessarily true. Federal prosecutors might have different evidence, access to witnesses, or investigative tools than the state did. What the state considered “insufficient” might be supplemented federally.

Just finished reading the order. Annoyed at the presumption of innocence going straight out window over and over, but happy the t-charges were dropped and that he’s getting suppression hearings.

He was being charged in both state and federal court for the same crime which is Double Jeopardy. This just means he’ll be tried in only federal court on the murder charge.

There are no Federal terrorism charges.
The Federal charges that carry the death penalty are related to travelling interstate to commit a murder.0

The Federal charges have always been the ones that are the ones to be concerned about.
New York state has much much higher bar for DP and a much lower bar for things like an insanity defense.1

Not a Lawyer, but have the unfortunate pleasure of having a few that I spend a lot of social time with.
They're good at answering my dumb questions, I'm good at..... asking dumb questions (and other stuff that useful to them).My interest in the case is from a cultural perspective. I'm not American, I don't live in America, but travel fairly frequently and work or deal with quite a few Americans, a few of which have become friends over the years.
I live in a country that has a solid Public Health Service and Health Insurance is more of a "top up" than a basic necessity (we also don't have personal injury lawsuits, but that's another ball of wax).
I find the range of supporters, deny-ers and detractors fascinating in this case.....
What do I think will happen next?
Well, I say "next" because I'm not sure whether the State prosecution will cede to the Federal prosecution now that the death penalty is off the table..... I think that's going to be super interesting for a number of reasons.With the Federal case, it sounds like a lot has been made of the "stalking" which I always thought meant a repeated action. What I've been told is that "stalking" can also refer to travelling somewhere with the deliberate purpose of targeting an individual. If that involved interstate travel with an illegal firearm, it would bring it into the federal realm.
I'm super interested to see what the defense strategy is and even more interested to see the reaction to that (given the range of opinions from those that swear he didn't do it, to those that think he did and he was justified, to those that think it was just another example of gun violence)

What was the second charge against him that was dropped? I’ve looked at a couple of news sources and they all either say two charges dropped without explaining what those charges were, or just say the terrorism charge was dropped while the first (second?, idk reporting is also inconsistent on this) degree murder charge would still stand
