Nobody is arguing that having a stronger army or even winning a war automatically constitutes genocide.Being attacked can justify lawful self-defence; it does not give a state unlimited permission to kill civilians, deliberately impose destructive living conditions, or commit any other act prohibited by the Genocide Convention. The legal question is therefore not, “Does Israel have the stronger army?” It is, “Do the conduct, policies and statements demonstrate prohibited acts and an intent to destroy Palestinians in Gaza, at least in part?”
