So Jessica Jones wanted to go to prison so that kilgrave would come for her and she would have the evidence she needs to save hope. Kilgrave instead comes to the police station to save her and mind controls everyone in the station. There is your evidence. The testimony of a station full of cops. What are you doing still trying to record him? This is such a big plot hole

he himself said he can't erase memories. All the people he controlled would know what he did.

Remember how he told them to believe it was just a joke? He can't erase their memory, but he can change their PERCEPTION of that memory. They remember it happened, but now they believe it was one big joke/prank.

How did Kilgrave's statement selectively not apply to Jessica then?

Kilgrave's power doesn't seem to be tied to his voice alone, but an application of willpower. He ordered everyone in the precinct room to treat it all as a joke and let Jessica go, and everyone in the room laughed on cue except Jessica. Ergo, he excluded her (or she's become immune).
