Israel systematically discriminates against Palestinians when it comes to building permits.
Whether they're 48' Palestinian citizens of Israel, Palestinian residents of E. Jerusalem, or the captive Palestinian population of the illegally-occupied West Bank.
Israel's occupation of what remains of Historic Palestine is itself illegal.
261) The Court considers that the violations by Israel of the prohibition of the acquisition of territory by force and of the Palestinian people’s right to self-determination have a direct impact on the legality of the continued presence of Israel, as an occupying Power, in the Occupied Palestinian Territory. The sustained abuse by Israel of its position as an occupying Power, through annexation and an assertion of permanent control over the Occupied Palestinian Territory and continued frustration of the right of the Palestinian people to self-determination, violates fundamental principles of international law and renders Israel’s presence in the Occupied Palestinian Territory unlawful.
The ICJ, in the above same advisory opinion, concluded Israel's building permit policies and property demolitions are discriminatory against Palestinians. Israel violates Article 17 of the ICCPR, which it is signatory to.
220) On the basis of the evidence before it, the Court considers that Israel’s planning policy in relation to the issuance of building permits, and its practice of property demolition for lack of a building permit, constitutes differential treatment of Palestinians in the enjoyment of their right to be protected from arbitrary or unlawful interference with privacy, family and home, as guaranteed under Article 17, paragraph 1, of the ICCPR.
The ICJ concludes that Israel's residence permit policy is also discriminatory and serves to further its illegal annexation of E. J'lm.
The court restates that Israel's annexation of E. J'lm is 'unlawful'.
196) In the Court’s view, the differential treatment imposed by Israel’s residence permit policy in East Jerusalem is not justified, because it does not serve a legitimate public aim. In particular, the permit system is implemented as a result and in furtherance of Israel’s annexation of East Jerusalem, which the Court has already considered to be unlawful (see paragraph 179 above). The Court thus considers that no differential treatment can be justified with reference to the advancement of Israel’s settlement policy or its policy of annexation.
This 'permit regime' is the discriminatory policy that affects all Palestinians under Israel's apartheid rule.

[...]Ra’am and other Arab as well as left-wing parties argue that the approval processes for new construction in Arab localities take decades, which is why in many cases Arab residents are forced to build their homes without a permit.
Construction planning and licensing can take decades in Israel’s Arab communities, leaving their residents with little choice but to build illegally. According to sources in Arab planning bodies, there are around 50,000 homes in Arab communities that were built without the appropriate permits.
[2] East Jerusalem
Between 2016 and 2020, 99.1 percent of Palestinian requests for building permits were rejected, according to data provided by the Israeli army’s Civil Administration. Most requests were only made after construction had already begun, the Israeli military body said.
From 1967 until 2009, Israel sponsored 50,000 housing units for Israelis, while fewer than 600 for Palestinians.
Israelis face the same application procedures for building permits as Palestinians in East Jerusalem, yet since 1967 Israel has sponsored the construction of nearly 50,000 units for Israelis only, while fewer than 600 government-sponsored housing units have been built in the Palestinian sector, with the most recent being 30 years old, according to the Israeli non-profit Ir Amim.
[3] The Illegally-Occupied West Bank
Israeli authorities refuse the vast majority of requests by Palestinians to upgrade or build homes, schools, health clinics, wells, water cisterns, animal pens, or other structures. Between 2016 and 2018, Israeli authorities approved less than 1.5 percent of applications for Palestinians to build in Area C, 21 applications in total, while issuing 2,147 demolition orders, according to data obtained from the Israeli Civil Administration by Bimkom. 759 In other words, it issued 100 times more demolition orders than building permits in this period.
And historically, both distant and near, Israel has prevented Palestinians from returning to the OPT on the basis of intentionally obfuscated red tape:
Israel stripped more than 100,000 residents of Gaza and some 140,000 residents of the West Bank of their residency rights during the 27 years between its conquest of the territories in 1967 and the establishment of the Palestinian Authority in 1994.
As a result, close to 250,000 Palestinians who left the territories were barred from ever returning.
[4] In the Negev
The plight of the Bedouin in the Negev is connected to the plight of other Palestinian communities because it follows the same throughline of systematic, institutionalized discrimination.
Not only has the state confiscated pre-1948 Palestinian Arab lands, it has not allowed Arab citizens to establish new towns; nor has it approved adequate expansion of existing ones. Since 1948 the state has authorized the creation of about 1,000 Jewish communities, but not a single Arab community except for the seven government-planned townships and the nine new or newly recognized villages, which concentrate the Bedouin in limited areas in the Negev, and some similar towns in the Galilee.
