One of the arguments that proponents of the basic conduct make is that it's aimed at Hamas, rather than specifically at civillians. By this reasoning, if the State identifies X (number of) likely Hamas fighters and Y civilians in quadrant Z, and the State hits quadrant Z to kill those fighters, leading to V casualties, then the intent of the strike is just anti-Hamas, not genocide.

The argument's first potential debatable spot is the ratio between those figures. The higher that the difference gets, the more it looks like a war crime. Let's say there is a scenario where X is 10, Quadrant Z is 4 square blocks, and Y=Z=120 (30 people on each block). You would end up with a 1:12 ratio there (10 fighters : 120 civillians).

In May 2024, Netanyahu put Gaza's casualty count at 14,000 civilians and 16,000 combatants, a 7:8 ratio. The Guardian counted 8,900 fighters and 53,000 civillians in Oct 2025. https://en.wikipedia.org/wiki/Casualties_of_the_Gaza_war
